Intoxicating Liquor for On-sale § 7.52 <br /> <br />Person to be furnished or consume any such alcoholic beverage on the <br />licensed premises. <br /> <br />No person under twenty one (21) years of age shall .misrepresent his age for <br />the purpose of obtaining intoxicating liquor nor shall such person enter any <br />premises licensed for the retail sale of an alcoholic beverage for the purpose of <br />purchasing or having served or delivered to such person for consuming any <br />such alcoholic beverage, nor shall any person purchase, attempt to purchase, <br />consume, or have another person purchase for on that person's behalf, any <br />alcoholic beverage. <br /> <br />No person under 21 years of age shall receive delivery of an alcoholic <br />beverage. <br /> <br />No person shall induce a person under the age of twenty one (21) years to <br />purchase or procure or obtain an al.coholic beverage. <br /> <br />Any person who may appear to the licensee, the licensee's employees or <br />agents, to be under the age of twenty-one (21) shall, upon demand of the <br />licensee, an employee or agent, produce, and permit to be examined an <br />identification certificate issued by any Administrator of District Court in the <br />State of Minnesota pursuant to Section 626.311 through 626.319, Minnesota <br />Statutes. <br /> <br />In every prosecution for a violation of the provisions of this ordinance relating <br />to the sale or furnishing of alcoholic beverage to persons under the age of <br />twenty-one (21) years, and in every proceeding before the city council with <br />respect thereto, the fact that the minor involved has obtained and presented to <br />the licensee, an employee or agent, a verified identification card issued'by the <br />Clerk of Disu'ict Court in the State of Minnesota, from which it appears that <br />said person was twenty-one (21) years of age and was regularly issued such <br />identification card, shall be prima facie evidence that the licensee, the agent or <br />employee is not guilty of a violation of such a provision and shall be <br />conclusive evidence that a violation, if one has occurred, was not willful or <br />intentional. <br /> <br />Proof of age for purchasing and consuming alcoholic beverages may be <br />established only by a valid state driver's license or state identification card; or <br />in the case of a foreign national, by a valid passport. <br /> <br />7.52.16 <br /> <br />Other restrictions on purchase or consumption <br /> <br />No person shall give, sell, procure or purchase alcoholic beverage for any <br />person to whom the sale of alcoholic beverage is forbidden by state law or <br />this ordinance. <br /> <br /> b. No person shall mix or prepare alcoholic beverage for "on-sale" consumption <br /> in any public place not licensed in accordance with this code and the laws of <br /> the State of Minnesota <br /> <br />//6, <br /> <br /> <br />
