That the property owner of the Subject Property shall participate in any street maintenance <br />assessments to 173rd Avenue N.W., the street from which it receives the benefit of public <br />access, until such time as the Subject Property is platted and served by public streets <br />interior to the plat. <br /> <br />Prior to the issuance of a building permit for a dwelling on the Subject Property, the <br />property owner shall be required to deposit with the City a cash escrow or letter of credit, <br />approved as to form by the City, in the amount of $ The purpose of the <br />financial guarantee is to ensure correction, in a timely manner, of a~y drainage problems <br />resulting from the creation of the driveway and mm-around. In the event the property <br />owner fails to correct the drainage problems, the City may make the corrections with City <br />day labor and/or by letting contracts for said corrections and draw upon the escrow for <br />payment. The property owner hereby grants permission and a license to the City and/or its <br />contractors and assigns to enter upon the Subject Property for the purpose of completing <br />the corrections in the event of the Property Owner's default. <br /> <br />The property owner shall obtain all necessary permits prior to commencing any <br />construction. The residential structure and any accessory buildings constructed on the <br />Subject Property shall not interfere with the orderly resubdivision of the Subject Property at <br />some point in the future, and shall be located in such a way as to comply with rural <br />residential setback requirements and Item #4 above. <br /> <br />The property owner agrees that this variance shall be recorded in the office of the Anoka <br />County Recorder and agrees that the terms and provisions of this Agreement shall run with <br />the land and shall bind the property owner and his/her successor and assigns. <br /> <br />10. <br /> <br />The property owner shall be responsible for all City costs incurred in administering and <br />enforcing this variance. <br /> <br />11. <br /> <br />12. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Board Member <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />whereupon said resolution was declared duly adopted by the Ramsey Board of Adjustment this the <br /> day _. ,1995. <br /> <br /> <br />
