Subdivision · § 9.50 <br /> <br />It is the policy of the City that the following standards and guidelines for tho dedication of land for <br />park, playground, and public open space purposes (or cash contributions in lieu of such <br />dedication) in the subdividing and developing of land within thc City shall be directly related to the <br />density and intensity of each subdivision and development. It is further the policy that it is <br />intended that subdivision dedication shall fa'st be allocated toward deficiencies in the subdivision, <br />neighborhood or specific district park(s), then to trails linking parks, then community parks, then <br />multi-jurisdictional park(s) in the City. Finally, that dedication fees recognize the impact upon each <br />of these systems by the subdivision of land. <br /> <br /> Subd. 2. Residential parkland dedications. The amount of land to be <br />dedicated by a subdivider for residential development shall be based on the gross area of the <br />proposed subdivision, proposed type of dwelling unit and density.. <br /> <br />The formula for land dedication shall be based on the number ofproposed units per acre. <br /> <br />Dwelling Units <br /> <br />0 - 0.3 units per acre <br />0.3t - 3.0 units per acre <br />3.1 - 5.0 units per acre <br />5.1 .+. units per acre <br /> <br />La.nd To Be Dedicated <br /> <br />7% <br /> <br />10% <br /> <br /> 12% <br />Add .5% for each unit over 5 <br /> <br /> Subd. 3. Industrial/commercial parkland dedication, Subdividers of <br />commercial/industrial land, including commercial/industrial portions of Planned Unit <br />Developments, shall be required at the time the final plat is approved to dedicate to the City for <br />park, playground, and public open space purposes, an amount of land up to 5% of the gross land <br />area as determined by the Council. '- <br /> <br /> Subd. 4. Planned unit' development (PUD's). Parkland dedication <br />requirements for PUD's shall provide a minimum of ten percent (10%) for public open space and <br />recreational uses or cash in lieu of land in addition to those special requirements in §9.20.31. <br /> <br /> Subd. 5. Standards for accepting dedication of land for public park <br /> <br />purposes, <br /> <br />be <br /> <br />Land proposed to be dedicated for Public purposes shall meet the needs <br />of the City. <br /> <br />Prior to dedication for public purpose, the subdivider shall deliver to <br />the City Attorney, an abstract of tide or registered property abstract for <br />such dedication. -Such title shall vest in the City good and marketable <br />title, free and clear of any mortgages, liens, encumbrances, assessments <br />and taxes. The conveyance documents shall be in such form acceptable <br />to the Council. <br /> <br />The required dedication shall be made at time of final plat approval. <br /> <br />The removal of trees, topsoil, storage of construction equipment, <br />burying of construction debris, or stockpiling of surplus soils is strictly <br />forbidden without the written approval of the Council. <br /> <br />Grading and utility plans, which may affect or impact the proposed park <br />dedication, shall be reviewed and approved by the Parks and Recreation <br />Commission prior to dedication, or at such time as is reasonably <br />determined. <br /> <br /><~ Printed 4/5/95 <br /> <br />Page 477 <br /> <br /> <br />
