§ 9.50 Subdivision <br /> <br /> f. To be eligible for park dedication credit, any land to be dedicated as a <br /> requirement of this Section shall be useable, developable land for use <br /> for park and recreation purposes and shall be at a location convenient to <br /> the people to be served. <br /> <br />Stlbd. 6. Cash payment. In lieu of land dedication, the Council may require <br />the subdivider tO contribute a cash payment. The value of such payment shall be the greater <br />amount established by a specified contribution per dwelling unit or a percent of fair market value of <br />the undeveloped~and commensurate with the percent of land which otherwise would have been <br />required under §9.50.37 Subd. 2 and §9.50.37 Sulxl. 3. The specified contribution per dwelling <br />unit shall be bas~ on the requirements in affect at the time final plat approval is granted. "Fair <br />Market Value", f6r purposes of this subdivision, shall be determined at the time of approval of the <br />£mal plat in accordafice with the following: ' <br /> <br /> a. The Park and Recreation Commission and subdivider may agree upon a <br /> recommendation to the Council as to the fair market value based upon <br /> recommendation by the Assessor. <br /> <br /> b. The Council after reviewing the Park and Recreation Commission's <br /> recommendation, may agree with the subdivider as to the fair market <br /> value, ff agreement is not reached in this manner, then fair market value <br /> shall be determined in accordance with the following: <br /> 1. The fair market value as determined by the Council based upon <br /> appraisals, accepted purchase agreements, comparable market <br /> transactions or other pertinent records as determined by the <br /> Council. <br /> <br />The Council, upon review and recommendation of the Park and Recreation Commission shall <br />annually determine by resolution the park and dedication fee per residential unit. <br /> <br />If, at the option o~ the Council it is determined that a cash dedication shall be made, said cash shall <br />be placed in a sp~ial fund for Parks and Recreation use and deposited by the developer with the <br />City prior to final plat approval. <br /> <br /> Subd. 7. Combination of land dedication and cash payment. In <br />appropriate plats, ia combination of land and cash may be required by the Council. In the event a <br />combination of l~d and cash is required, the amount of land to be dedicated shall be'credited <br />against the total pgk dedication requirement and the remaining cash contribution shall be based on <br />the greater of the Specified cash contribution per dwelling unit or the fair market value of the land. <br />When determininl~ the cash contribution for the remaining acreage, the overall density of the plat <br />shall be the basis for determining the potential number of dwelling.units per acre.' <br /> <br /> Subd. 8. Scenic easements. In appropriate plats, as determined by <br />agreement betwee~n the Council and the subdivider, the subdivider may dedicate to the public a <br />scenic easement iff combination with the requirements of §9.50.37 Subd. 2 and 3 above or, if the <br />subdivider and COuncil agree, the scenic easement dedication may be in lieu of up to 25% of the <br />requirements in §~}.50.37 Subd. 2 and 3 above. <br /> <br /> Subd. 9. Required improvements. Subdividers shall be responsible' for <br />making certain ir~provements to the parkland they dedicate within their development for park, <br />playground and public open space purposes as follows: <br /> <br /> a. Provide finish grading and turf e~tablishment for all park,'playground, <br /> trail and public open spaces and provide landscape screening in <br /> accordance with City Policy. <br /> <br />Page 478 Printed 4/5/95 <br /> <br /> <br />
