Subdivision § 9.50 <br /> <br />9.50.38 <br /> <br />Construct and pave trails which are identified by the City as accessible <br />bikeway/walkway ta~ils in accordance with City Standards concurrently <br />with the roads in their developments (i.e., grading with site grading and <br />paving with street or parking lot paving). Grade and provide <br />appropriate surfacing, as approved by the Park and Recreation <br />Commission, of trails identified by the City as horse or wilderness <br />trails. Park dedication credit will be given for construction of the trail(s) <br />and associated improvements at a rate determined by the City Engineer. <br /> <br />Complete, construct, and pave waikways which may be required as a <br />trail link connector in accordance with City. Standards. Such walkways <br />may be within or abutting residential street right-of-ways. No park <br />dedication credit will be given for these connecting links or construction <br />thereof. <br /> <br />Establish park boundary comers for the purpose of erecting park limit <br />signs. Monuments of permanent character shall be placed by the <br />subdivider at all angle and curve points on the outside boundaries of ali <br />public property. <br /> <br />Provide sufficient public road access and surfaced, parking facility as <br />deemed appropriate by the Park and Recreation Commission after <br />consideration of the recommendation of the City Engineer for <br />neighborhood parks and community parks. <br /> <br />The-subdivider shall submit a topographical, site, grading and landscape <br />plan prepared by a registered engineer or landscape architect to the City <br />for approval during the preliminary plat process. <br /> <br /> Subd. 10. Agreement as to dedication. Agreements as to the <br />requirements in t}9,50.37 shall be made as part of a performance contract presented for approval <br />along with the final plat. Failure of the Council and subdivider to reach agreement regarding the <br />matters in {}9.50.37 above shall constitute denial of the plat. <br /> <br /> Subd. i1. Exceptions. In the case of a request to divide a lot which is a <br />part of a recorded plat where the division is to permit the adding of a parcel of land to an abutting <br />lot which does not create a new buildable 13t, the subdivider shall be exempt from complying With <br />any procedural requirements of this section. <br /> <br /> Subd, 12. Application to minor subdivisions. In the event of a <br />minor subdivision, the provisions of this Chapter shall apply to the new lots being created rather <br />than the gross area being subdivided. <br /> <br />Subd. 13. Application to resubdivision. <br /> <br />In the event of a resubdivision of a parcel for which' park dedication <br />requirements have previously been met, no additional park dedication <br />requirements shall be imposed as a result of the resubdivision providing <br />the overall density of development of the parcel remains the same as the <br />density allowed under the zoning in effect at the time of the initial <br />subdivision. <br /> <br />In the event that park dedication requirements were met through the use <br />of a fee per dwelling unit or based on the value of the improvement, <br />additional park dedication shall be made for each new lot created under <br />resubdivision. <br /> <br />The park dedication fee shall be based on the specified contribution per <br />dwelling unit for residential properties resulting from the resubdivision. <br /> <br />r~age 479 <br /> <br />Flood Plain Requirements. <br /> <br /> <br />
