Grading and utility plans, which may affect or impact the <br /> proposed park dedication, shall be reviewed, and approved by <br /> the P~rks -,.nd R~ea~on Cc,~':'2ss~.~,n City Engineer prior to <br /> dedication, or at such time as is reasonably determined. <br /> <br /> f. To be eligible for park dedication credit, any land to be dedicated <br /> as a requirement of this section shall be useable, developable <br /> land for use for park and recreation purposes and shall be at a <br /> location convenient to the people to be served. -- <br /> <br /> P Subd. 6. Cash payment. In lieu of land dedication, the Council may <br />require the subdivider to contribute a cash payment. The value of such payment shall be <br />the greater arr!ount established by a specified contribution per dwelling unit or a percent of <br />fair market v~ue of the undeveloped land commensurate with the percent of land which <br />otherwise wo,~ld have been required under §9.50.37 Subd. 2 and {}9.50.37 Subd. 3. The <br />specified con0'ibution per dwelling unit shall be based on the requirements in affect at the <br />time final pl~ approval is granted. Fair Market Value, for purposes of this subdivision, <br />shall be determined at the time of approval of the final plat in accordance with the <br />following: <br /> <br /> a. The Park and Recreation Commission and subdivider may agree <br /> upon a rex:ommendation to the Council as to the fair market value <br /> based upon recommendation'by the Assessor. <br /> <br /> b. The Council after reviewing the Park and Recreation <br /> Commission's recommendation, may agree with the subdivider <br /> as to the fair market value. If agreement is not reached in this <br /> manner, then fair market value shall be determined in accordance <br /> with the following: <br /> 1. The fair market value as determined by the Council based <br /> upon appraisals, accepted purchase agreements, <br /> comparable market transactions or other pertinent records <br /> as determined by the Council. <br /> <br />The Council,/upon review and recommendation of the Park and Recreation Commission <br />shall annuall3t determine by resolution the park and dedication fee per residential unit. <br /> <br />If, at the option of the Council it is determined that a cash dedication shall be made, said <br />cash shall be!placed in a special fund for Parks and Recreation use and deposited by the <br />developer wis the City prior to final plat approval. · <br /> <br /> , Subd. 7. Combination of land dedication and cash payment. <br />In appropriat,e plats, a combination of land and cash may be required by the Council. In the <br />event a coml~ifiation of land and cash is required, the amount of land to be dedicated shall <br />be credited against the total park dedic'ation requirement and the remaining cash contribution <br />shall be base~, on the greater of the specified cash contribution per dwelling unit or the fair <br />market valu6 of the land. When determining the cash contribution for the remaining <br />acreage, the ioverall density of the plat shall be the basis for determining the potential <br />number of d,4'elling units per acre. <br /> <br /> ~ Subd. 8. Scenic easements. In appropriate plats, as determined by <br />agreement ~tween the Council and the subdivider, the subdivider may dedicate to the <br />public a scenic easement in combination with the requirements of §9.50.37 Subd. 2 and 3 <br /> <br /> <br />
