Subdivision - Design Standards § 9.50.30 <br /> <br /> b. Assessments. The procedure for the installation and <br /> assessment of the cost of improvements under this section shall <br /> be the same as that provided for improvements in areas zoned <br /> for residential classifications pursuant to §9.50.50 Subd. 4 <br /> except that: <br /> 1. Special assessments for the cost of sanitary sewer, storm <br /> water and water system improvements 'shall be for a period <br /> of ten (10) years; and <br /> 2. A financial guarantee for the payment of the special <br /> assessments for sanitary sewer, storm water and water. <br /> system improvements shall obligate the owner or <br /> subdivider for the length of the assessment. <br /> <br /> Subd. 6. Subdivider may perform work, election. The <br />owner/subdiv~tier may elect to construct the improvements required by this section at their <br />own expense ~and without City 'participation in the expense thereof. In such event, the <br />owner/subdivider may retain an engineer and contractor to plan, design and install such <br />services, subj~t to review and inspection by the City Engineer. The estimated cost of the <br />improvementS, including the administrative charges of the City for supervision and <br />inspection, shrill be included in the owner/subdivider's contract with the City pursuant to <br />§9.50.50 Sub(~. 7, and the appropriate financial guarantee in a form acceptable to the City, <br />shall be depos.lted with the City as required by that section. <br /> ;' Subd. 7. Pel~formance contract. Prior to the installation of any <br />required impr{)vements by a subdivider and prior to Council approval of the final plat, the <br />subdivider slmll enter into a contract with the City, which contract shall require the <br />subdivider to !construct said improvements at the sole expense of the subdivider and in <br />accordance w[th City approved constructions plans and specifications and all applicable <br />City standardS. Said contract shall provide for the supervision of the construction by the <br />City Engineer.~and shall require that the City be reimbursed for all costs incurred by the City <br />for engineerir~g and legal fees and other expenses in connection with the making of such <br />improvements~. The performance of said contract shall be'secured by a financial guarantee, <br />in a form ac~ptable to the City, as hereinafter set forth. No performance contract or <br />financial sect/r[ty shall be required for any improvement which is not a requirement for <br />approval of th~ final plat. The contract shall.also provide that the subdivider give a one (1) <br />year warrant~ and guarantee to the City from date of acceptance by the City on all <br />improvements constructed on behalf of or dedicated to the City. <br /> <br /> Subd. 8. Construction'Plans (All Development Areas). <br />Construction [Plans and specification for the required improvements conforming in all <br />respects with It_he code and standards of the City shall be prepared at the expense of the <br />subdivider by ~a professional engineer registered by the State of Minnesota. Such plans and <br />specificafion~ shall be approved by the City Engineer and shall become a part of the <br />performance 6ontract. Two (2) prints of said plans and specifications shall be filed with the <br />Adm~mstrator;or designated representative. <br /> <br /> ~Subd.9. Inspection (Ail Development Areas). All required <br />improvements~ shall be inspected during the course of construction by the City Engineer and <br />acceptance oflsaid improvements by the City shall require the prior written certification by <br />the City Engiheer that said improvements have been constructed in compliance with the <br />plans and specifications. <br /> <br /> Subd. 10.
