Subdivision - Design Standards § 9.50.30 b. Assessments. The procedure for the installation and assessment of the cost of improvements under this section shall be the same as that provided for improvements in areas zoned for residential classifications pursuant to §9.50.50 Subd. 4 except that: 1. Special assessments for the cost of sanitary sewer, storm water and water system improvements 'shall be for a period of ten (10) years; and 2. A financial guarantee for the payment of the special assessments for sanitary sewer, storm water and water. system improvements shall obligate the owner or subdivider for the length of the assessment. Subd. 6. Subdivider may perform work, election. The owner/subdiv~tier may elect to construct the improvements required by this section at their own expense ~and without City 'participation in the expense thereof. In such event, the owner/subdivider may retain an engineer and contractor to plan, design and install such services, subj~t to review and inspection by the City Engineer. The estimated cost of the improvementS, including the administrative charges of the City for supervision and inspection, shrill be included in the owner/subdivider's contract with the City pursuant to §9.50.50 Sub(~. 7, and the appropriate financial guarantee in a form acceptable to the City, shall be depos.lted with the City as required by that section. ;' Subd. 7. Pel~formance contract. Prior to the installation of any required impr{)vements by a subdivider and prior to Council approval of the final plat, the subdivider slmll enter into a contract with the City, which contract shall require the subdivider to !construct said improvements at the sole expense of the subdivider and in accordance w[th City approved constructions plans and specifications and all applicable City standardS. Said contract shall provide for the supervision of the construction by the City Engineer.~and shall require that the City be reimbursed for all costs incurred by the City for engineerir~g and legal fees and other expenses in connection with the making of such improvements~. The performance of said contract shall be'secured by a financial guarantee, in a form ac~ptable to the City, as hereinafter set forth. No performance contract or financial sect/r[ty shall be required for any improvement which is not a requirement for approval of th~ final plat. The contract shall.also provide that the subdivider give a one (1) year warrant~ and guarantee to the City from date of acceptance by the City on all improvements constructed on behalf of or dedicated to the City. Subd. 8. Construction'Plans (All Development Areas). Construction [Plans and specification for the required improvements conforming in all respects with It_he code and standards of the City shall be prepared at the expense of the subdivider by ~a professional engineer registered by the State of Minnesota. Such plans and specificafion~ shall be approved by the City Engineer and shall become a part of the performance 6ontract. Two (2) prints of said plans and specifications shall be filed with the Adm~mstrator;or designated representative. ~Subd.9. Inspection (Ail Development Areas). All required improvements~ shall be inspected during the course of construction by the City Engineer and acceptance oflsaid improvements by the City shall require the prior written certification by the City Engiheer that said improvements have been constructed in compliance with the plans and specifications.
