In an area not having municipal storm sewer trunk, the applicant shall be responsible, before platting, to provide for a storm water disposal plan in accordance ~ith the City's Comprehensive Drainage Plan without damage to properties outside the p~tted area and said storm water disposal plan shall be submitted to the City Engineer, wh~ shall report to the Council on the feasibility of the plan presented. No plat shall be app~ved before an adequate storm water disposal plan is presented and approved by the City E~ngiheer and Council. The use of dry wells for the purpose of storm water disposal is p~ohibited. In areas where an outlet for storm water does not exist and the developer is ~unable to negotiate a drainage way with adjacent land owners, they may petition the City to construct a drainage outlet. 9.50.55 ~ Election by City to install improvements. As stated in §9.50.50 Sub& 6, the sObdivider may elect to construct the improvements at their own expense and without City ~articipation in the expense. However, the City reserves the right to elect to install all or iany part of the improvements required under the provisions of this title pursuant to M.S., Chapter 429,.as amended. If the City elects to install the improvements, the develope~ shall post a financial guarantee, in a form acceptable to' the City, for the payment of trl~ assessments. 9.50.56 .: Subsurface conditions. The subdivider shall cause tests to be made of subsurface conditions to determine the nature and extent of subsurface soil, rock and water. The location atnd results of said tests shall be made available to the City. 9.5'0.57 Sidewalks and pedestrian ways. Subd. 1. All sidewalks and pedestrian ways required by the City shall be constructed of a four inch (4") concrete placed on a four inch (4") gravel base. Grades shall be as approved by the City Engineer. Sidewalks shall be placed in the public ROW one foot (1') ff~om the property line and shall be a width designated by the City. ~ Subd. 2.
