fo <br /> <br />After receiving the recommendations of the Planning Commission and considering <br />the criteria listed in this subdivision, the Council shall, with a majority vote, take <br />one of the following actions: <br /> <br />1. Appmval. <br /> <br />(a) <br /> <br />By resolution, adopt Findings of Fact that support approval of the <br />requested accessory apartment permit. <br /> <br />(b) <br /> <br />By resolution, authorize the issuance of an accessory apartment <br />permit. This resolution should list any condition or conditions that <br />the Council considers necessary to meet the purpose of this Section <br />and protect the public's health, safety and welfare. <br /> <br />2. Denial. <br /> <br />(a) <br /> <br />By resolution, adopt Findings of Fact that support denial of the <br />requested accessory apartment permit. <br /> <br />(b) <br /> <br />By motion, deny the issuance of an accessory apartment permit <br />based on the Findings of Fact. <br /> <br />Whenever an application for an accessory apartment permit has been considered and <br />denied by the Council, a similar application for an accessory, apartment permit <br />affecting substantially the same parcel shall not be considered again by the Council <br />for at least one year from the date of its denial. The Council may permit the <br />submittal of a new request for an accessory apartment permit within one year of <br />denial if it finds that the circumstances surrounding the new request have changed <br />significantly. <br /> <br />8.71.04 Permit Expiration, Revocation, R~newal <br /> <br />Unless otherwise specified by the Council at the time it is authorized, an accessory <br />apartment permit, upon written notice being provided by the City to the permit <br />holder but without further action by the Planning Commission or the City Council, <br />shall expire if the permit holder falls to initiate such accessory apartment and fulfill <br />each and every condition attached thereto within one year from the date of its <br />authorization or if the use is discontinued for a continuous 12-month period, unless <br />a petition for an extension of time in which to complete or utilize the use that has <br />been gamed by the Council. Such extension shall be requested in writing and filed <br />with the City at least 30 days before the expiration of the original accessory. <br />apartment permit.
