Case # ~ <br /> REQUEST T,O RENEW A CONDITIONAL USE PERMIT FOR AN ASPHALT <br /> PRQDUCTION PLANT; CASE OF COMMERCIAL ASPHALT <br /> ~ By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On July 12, 198~, the City of Ramsey issued a conditional use permit to Commercial Asphalt to <br />establish and op.e~ate a hot mix asphalt plant south of County Road #116, east of Basalt Street and <br />north of the Burli,~gton Northern Railroad tracks. That conditional use permit expired on January <br />31, 1995, and C~gmmercial Asphalt has submitted an application for the issuance of a new <br />conditional use p~rmit to continue the operation. <br /> <br />The following ite ..ms are enclosed for your information: <br /> <br /> a) Si~ location map <br /> b) Si~e plan <br /> c) I.~tter from Commercial Asphalt dated January 13, 1995 <br /> d) Prgposed findings of fact <br /> e) Pr?osed conditional use permit <br /> <br />Observations: : <br /> <br />The City has been[supplied with a letter dated January 13, 1995, from Commercial Asphalt which <br />indicates that ther{ are no changes proposed to plant operations. Hours of operation and amount of <br />truck traffic is esti~nated to remain the same as it has been since 1988. <br /> <br />During the past ~.ive years of operation, there have been occasions when extended hours of <br />operation have bd, en necessary. In accordance with the terms of theLr previous conditional use <br />permit, Commercial Asphalt always sought prior approval from the City for the extended hours of <br />operation and supplied an explanation of why the extension was necessary. Based on records <br />indicating that thee have not been any complaints regarding the operations of the asphalt plant, <br />City Staff has always approved the extension of hours for temporary per/ods of time. <br /> <br />Commercial Asphglt is permitted by MPCA and their current General Air Emission Permit expires <br />on January 25, 1998. <br /> <br />Recommendation: <br /> <br />City Staff recommends reviewing the findings of fact and approving the request for a conditional <br />use permit. <br /> <br />Commission Ac~tion: <br /> <br />Motion to recommend that City Council adopt Resolution g05-02- adopting Findings of Fact <br /># relatin~ to Commercial Asphalt's request for a conditional use permit for a hot mix <br />asphalt plant. : <br /> <br />- and - <br /> <br />Motion to recommend that City Council approve/deny the issuance of a conditional use permit to <br />Commercial Asph~t for a hot mix asphalt plant and adopt Resolution g05-02- declaring terms <br />of same. <br /> <br />Reviewed by: <br /> <br />City Engineer <br />Zoning AdministratOr <br /> <br />PC: 2/7/95 ~ <br /> <br />3/ <br /> <br /> <br />
