7 <br /> <br />If the violations are not corrected within the given 30 days, a public heating <br />conducted by the City Council shall be scheduled for the first regular <br />Council meeting occurring 30 days after the notice of possible violations of <br />the accessory apartment permit. <br /> <br />At the public hearing for the purpose of revoking the accessory apartment <br />permit, the City Council shall consider the evidence and with a majority vote <br />take one of the following actions: <br /> <br />(a) Revocation of the accessory apartment permit. <br /> <br />(1) By resolution, adopt Findings of Fact that support <br /> revocation of the accessory apartment permit. <br /> <br />(2) <br /> <br />By motion, revoke the accessory apartment permit based on <br />the Findings of Fact. <br /> <br />(b) Continuation of accessory apartment permit. <br /> <br />O) <br /> <br />By resolution, adopt Findings of Fact that support contin- <br />uation of the accessory apartment permit. <br /> <br />(2) <br /> <br />By resolution, confirm the continuation of the accessory <br />apartment permit and reaff'mn the conditions of the permit. <br /> <br />Tt~e accessory apartment permit, and any extension of said permit, shall terminate <br />uppn the death of the permit holder, or the joint tenant survivor of the permit holder; <br />upbn the transfer of title to said premises; or upon the permit holder or the joint <br />ten, ant survivor of the permit holder no longer occupying the premises as their <br />principal residence. <br /> <br />UP, on the sale of a home having an accessory apartment permit, the buyer must <br />renew the permit but will not be subject to the two-year occupancy requirement. <br />Thb procedure for permit renewal by the home buyer shall require submittal of an <br />acdessory apartment application form and fees and affidavit of residency and <br />o~ership. If there have been no changes made or changes proposed to be made to <br />the; site plan and floor plan that was originally considered in permit issuance, then <br />City Council may approve renewal and transfer of the permit without a public <br />he ~aring and recommendation from the Planning Commission. <br /> <br />8.71.05 Criteria <br /> <br />ThO total occupancy level of the accessory unit created and the remaining portion of <br />theioriginal single family structure shall be in accordance with the State Building <br />Cod~e or 300 square feet per person. <br /> <br />No iexterior changes shall be made to the house, including additions or added <br />entrances, which in the judgment of the City do not conform to the single family <br />character of the neighborhood. The accessory apartment shall be designed so that, <br />to the degree reasonably feasible, the appearance of the building remains that of a <br />one!family residence. Construction or conversion of a garage loft or an accessory <br />structure to an accessory apartment is prohibited. <br /> <br /> <br />
