do <br /> <br />fo <br /> <br />mo <br /> <br />The house must be owner-occupied by someone having at least fifty percent (50%) <br />interest in the property, except for bonafide temporary absences not to exceed six <br />months. During owner absence from the property, the vacant unit shall not be <br />allowed for rental. Unless otherwise approved by the City, the owner must have <br />resided in the home for more than two years prior to applying for the accessory <br />apartment permit. <br /> <br />There shall be no on-street parking allowed for residents of the structure and a <br />minimum 2-stall garage is required, the principal use of which will be vehicle <br />storage. <br /> <br />The accessory apartment and remaining portion 'of the original single family <br />structure must meet applicable standards and requirements of the State Building <br />Code, Anoka County health codes, and fire codes. <br /> <br />The building and property shall remain owner-occupied and shall have only one <br />mailing address. <br /> <br />Only one accessory apartment permit may be issued per single family home. <br /> <br />In order to encourage the development of housing units for disabled and <br />handicapped individuals and persons with limited mobility, the City Council may <br />allow reasonable deviations from these stated criteria where necessary to install <br />features that facilitate access and mobility for disabled persons. <br /> <br />An accessory apartment may not be added where a home occupation is already <br />located on the premises. <br /> <br />No accessory apartment may be established in a single-family residence concurrent <br />with the renting of rooms. <br /> <br />The garage shall not be converted to additional living space without replacing the <br />garage with at least a 2-stall garage. <br /> <br />Adequate provisions shall be made for the disposal of sewage, and the permit <br />holder shall absolve the City from any and all obligation associated with the <br />issuance of the permit as a result of the intensified use of the property and its <br />sewage disposal system.. <br /> <br />The permit holder must be willing to incur the inspection costs and subject the home <br />and apartment to an inspection by the City for compliance and safety purposes <br />annually, or at any time upon reasonable request. <br /> <br />The permit holder shall not allow a nuisance situation to exist with respect to noise, <br />outside storage, home and yard maintenance, or any other circumstance which is <br />deemed to aggravate the repose of the neighborhood or area. <br /> <br />The permit holder shall be responsible for costs incurred to record the accessory <br />apartment permit with the Anoka County Recorder's office. The City shall be <br />responsible for notifyin.g the Anoka County Assessor of the issuance of the <br />accessory apartment permit. <br /> <br />The accessory apartment shall not be served by separate utilities including, but not <br />limited to, furnace, gas and electric meters, well, and septic system. <br /> <br /> <br />
