Scenic River § 9.23 <br /> <br /> Structure means any building, sign, or appurtenance thereto, except aerial or <br />underground utility lines, such as sewer, electrical, telephone, telegraph, or gas lines, including <br />towers, poles, and other supporting appurtenances, and fences used to control livestock or <br />delineate boundaries. <br /> <br /> Subdivision means improved or unimproved land or lands which are divided for <br />the purpose of ready sale or lease, or divided successively within a five year period for the purpose <br />of sale or lease, into three or more lots or parcels of less than five acres each, contiguous in area <br />and which are under common ownership or control. <br /> Substandard Use means any use within the Land Use District existing prior to <br />the date of enactment of this section which is permitted within the applicable land use district but <br />does not meet the minimum lot area, length of water frontage, structure setbacks or other <br />dimensional standards of the section. <br /> <br /> Variance means any modification or variation of official controls where it is <br />determined that by reason of exceptional circumstances, the strict enforcement of the official <br />controls would cause unnecessary hardship. <br /> <br /> Wetland shall be as defined in Minnesota Statute, §103G.005, subd. 18. <br /> <br />9.23.04 District application. <br /> <br /> Subdivision i. The Scenic River Land Use District of the Rum River, within <br />the City, is hereby divided into two areas, in accordance with MN Rules, parts 6105.1400 - <br />6105.1500. The portion of the Scenic River Land Use District located within the 2000 Urban <br />Area, Section 25, Section 36, and the South Half of Section 24, Township 32N, <br />Range 25W; and the South Half of Section 19, Township 32N, Range 24W, as <br />.~.~ ~.~ ~ ..... ,~ ~.. ~a ,~r~ shall be classified as an Urban Area; and the remainder of the Scenic <br />River Land Use District with/n the City shall be classified as a Rural Area. <br /> <br /> Subd. 2. The Scenic River Land Use District shall be shown on the Official <br />Zoning Map, as shall the urban and rural area portions of the district contained therein. <br /> <br /> Subd. 3. The provisions of MN Rules, parts 6105.0010 - 6105.0250, <br />6120.2500 - 6120.3900 shall apply within the Scenic River Land Use District, as specified in the <br />Rum River Management Plan. Where the provisions of the City Code are in conflict with the <br />Management Plan for the Rum River, the provisions of the Rum River Management Plan shall <br />apply. Copies of MN Rules, parts 6105.0010 - 6105.0250, 6120.2500 - 6120.3900, and the <br />Management Plan for the Rum River shall be kept on file in the office of the Administrator. <br /> <br />9.23.05 Uses <br /> <br /> Subdivision I. Urban Area. The Urban Area of the Scenic River Land <br />Use District is hereby designated the Urban Area Overlay District. <br /> <br /> a. Permitted Uses are all permitted uses allowed and regulated by the <br /> applicable zoning district underlying the Urban Area Overlay District, as <br /> indicated on the Official Zoning Map of Ramsey, Minnesota, except that <br /> public roads, utility crossings, and all private and commercial recreation <br /> uses shall be Conditional Uses. <br /> <br /> b. Conditional Uses are all conditional uses and applicable attached <br /> conditions allowed and regulated by the applicable zoning district <br /> underlying the Urban Area Overlay District, as indicated on the Official <br /> Zoning Map of Ramsey, Minnesota. Conditional uses are subject <br /> to the procedures in Section 9.23.11 Subd. 6. <br /> <br /> Subd. 2. Rural Areas. The uses allowed within the Rural Area of the Rum <br />River Scenic Land Use District shall be those prescribed for a Scenic River in MN Rules, part <br />6105.0100 as follows: <br /> <br /> <br />
