Councilmember introduced the following resolution and moved for its adoption: RESOLUTION ~$-04- A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A REQUEST FOR A CONDITIONAL USE PERMIT FO"'~ A GROUP FOSTER HOME. WHEREAS, Patrick J. McLafferty, hereinafter referred to as "Applicant", has properly applied for a Conditional Use Permit for a Group Foster Home on the property generally known as 7321 154th Lane N.W. and legally described as follows: The south 240 feet of the north 480 feet of the west 225 of the east 850 feet of the Southeast Quarter of the Northeast Quarter of Section 21, Township 32, Range 25, in Anoka County, Minnesota. Said distance being measured parallel with the east and north lines of said Southeast Quarter of Northeast Quarter (subject to an easement for road purposes over the south 33 feet thereof) together with an easement for road purposes over the following described legal - a 66 foot wide road easement over and across the Southeast Quarter of the Northeast Quarter of Section 21, Township 32, Range 25, in Anoka County, Minnesota. The cehterline of said easement being described as follows: Beginning at a point on the east line of said Southeast Quarter of Northeast Quarter. Said point being 480 feet south of the northeast comer thereof, thence west and parallel to the north line of said Southeast Quarter of Northeast Quarter a distance of 1,085 feet to a point thereinafter referred to as Point A, thence south and parallel to the east line of said Southeast Quarter of Northeast Quarter a distance of 451.93 feet, thence southeasterly on a curve to the left having a radius of 100 feet and a central angle of 88 degrees 53 minutes a distance of 155.13 feet, thence east and parallel to the north line of said Southeast Quarter of Northeast Quarter a distance of 986.93 feet to the east line of said Southeast Quarter of Northeast Quarter and there terminates said road easement to also include a mm around which is bounded by a circle having a radius of 60 feet and its centerpoint at above mentioned Point A. CITY 1. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Applicant appeared before the Planning and Zoning Commission for a public hearing pursuant to Section 9.03.04 (Conditional Use Permits) of the Ramsey City Code on March 7, 1995 and April 4, 1995 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. That the subject property is approximately one acre in size. That the subject property is zoned R-1 Rural Residential, which is a single family district. That by MS462.357, Subdivisions 7 and 8, State licensed residential facilities accommodating 6 or fewer persons is to be considered a permitted use in a single family district and facilities accommodating more than six (6) persons is to be considered a permitted use in a multi-family district. That the Applicant is proposing to increase the number of youth in the group foster home to eight (8).
