Councilmember r introduced the following resolution and moved for its adoption: [ r RESOLUTION 095-04- RESOLUTIO~ ADOPTING FINDINGS OF FACT # TO REZONE CERTAIN PROPERTY FROM B-1 BUSINESS TO B-2 BUSINE-'g'~- WHERE,_S, the City received an application to rezone certain property in accordance with Section 9.0~.03 of the Ramsey City Code; and NOW THEREi~ORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY,[ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That Pol/~a Dot Dairy, Inc., and Rum River Properties, hereinafter referred to as "Applica~ts", have properly applied to rezone certain property from B-1 Business to B-2 Business.~ That the P~lanning Commission conducted a public hearing pursuant to Section 9.03.03 of the City ~..ode on April 4, 1995 and that said public hearing was properly advertised and that the rn~nutes of said public hearing are hereby incorporated by reference. That the property proposed to be rezoned is legally described as follows: That part hereinaf~ Th 25 Su O~' lin th{ Ot of the following described property lying southerly of "Line A" to be described: at part of Government Lot 6, Section 36, Township 32, Range Anoka County, Minnesota, lying westerly of the centerline of te Trunk Highway No. 47 according to the duly recorded plats of 2BOW ADDITION, RIVER'S BEND PLAZA and RIVER'S ND PLAZA 3RD ADDITION; and lying north of the Northerly ~' of the right-of-way of County Road No. 116 as now shown on duly recorded plat of ANOKA COUNTY HIGHWAY RIGHT- !-WAY PLAT NO. 36. The West line of said Government Lot 6 is as now shown on the duly recorded plats of said OXBOW AI1}DITION and of MINERAL POND, and is also on the westerly exf~nsion of the monumented North line of the duly recorded plat of BI~OM ADDITION, said comer and line also being marked by Judicial Landmarks set pursuant to Torrens Case No. T-2299. Said "Lin{ A" being described as commencing at the Northwest corner of said Governm~t Lot 6; thence South 0 degrees 39 minutes 51 seconds East, assumed basis of bSarings, along the above described West line of Government Lot 6 for a distance o~' 653.32 feet to the actual Point of Beginning of said "Line A" to be hereby described; thence North 66 degrees 40 minutes 42 seconds East for a distance o[ 451.63 feet, more or less, to intersect said centerline of State Trunk Highway 1~o. 47 and there to terminate said "Line A". Contmmng 2.57 acres, more or less, north of said North line of the right-of-way of County R~ad No. 116. Subject to that part taken for said State Trunk Highway No. 47 over and across the easterly 33.00 feet thereof as measured at right angles to said centerline.
