'§' 9.20.31 Planned Unit Development <br /> <br /> Council its report, its findings, and its recommendation as to the <br /> appropriateness of the preliminary site plan, and shall recommend <br /> approval, modification, postponement, or disapproval based upon the <br /> criteria set forth in §9.03.03. <br /> i. The pmllm~nary site plan and the rezoning application shall bc scheduled <br /> for a Council meeting within 30 days after the submittal of the Planning <br /> Commission report. <br /> <br /> j. The Council shall consider the application for rezoning pursuant to <br /> §9.03.03 and shall approve, postpone, or disapprove the application for <br /> the rczoning. If thc application for rezoning in approved, thc Council <br /> shall approve or modify and approve thc preliminary site plan. <br /> k. The developer shall file final plans in accordance with the requirements <br /> in §9.03.03 with thc zoning officer at least 30 days before a Council <br /> me=ting. <br /> <br /> !, Thc Council, upon receipt of thc final plans may approve thc final plans <br /> if, in their determination, the proposed development is consistent with <br /> thc pr¢l~mlnary site plan, as approved. <br /> Subd~ 4. Major Changes. If thc applicant proposes major changes in the final <br /> site plan that arc inconsistent with thc preliminary site plan, these changes can only tm made by <br /> submission of a ncwlpreliminary site plan and rczoning application to thc zoning officer, and <br /> scheduling of a new! public hearing before thc Planning Commission and review again by the <br /> Council. <br />Thc following consti~tc major changes: <br /> a. Increase/n density; <br /> b. Change in architectural design or style; <br /> c. Change in type of ownership, private, condominium, or rental; <br /> d. Change of mom than 10% in total floor ama; <br /> ¢. Increase in height of any building;, <br /> f. Major modification in the landscal~ plan; <br /> g. Reduction in the proposed open space; <br /> h. Change in the dcvclopmcnt schedule; <br /> i. Change in thc road location or standards; and <br /> j. Any changes determined to be major by the Council. <br /> Subd, 5. Minor Changes. The Council may, in its discretion, permit minor <br />deviations from the.p~!~m~nary site plan which do not change thc concept or intent of thc proposed <br />development as prcvi0usly approved. <br /> <br /> Subd-~ 6. Denial. The Council shall deny any application if it finds the final <br />plans do not substar~ially conform to the preliminary site plan as previously approved by the <br />Council.
