The <br /> PUD was created to accommodate those homeowners who desire to have a business in an <br /> accessory structure on their residential property. The front 200 feet of each lot is reserved for <br /> residential uses and the remaining portion of the lot is permitted for commercial development only <br /> by the occupant of the home. There is a covenants governing the development of the lots and <br />' generally the City is not responsible for enforcing covenants. However, for purposes of reviewing <br />this application, it seems appropriate to note both City Code and covenants requirements. <br /> <br />Structure Size: <br /> <br />With a minimum 440 square foot garage, City Code requires 768 square feet on the main living <br />floor for ramblers. The covenants for Pineview Estates 2nd Addition requires a 400 square foot <br />garage with a minimum of 1,040 square feet on the main level for a rambler. The tuck-under <br />garage is 624 square feet and the dwelling is 1,512 square feet on the main level, which is in <br />conformance with City Code and the covenance. <br /> <br />Structure Setbacks: <br /> <br />City Code requires a 40 foot front yard, 10 foot side yard and 35 foot rear yard setback. The <br />covenants for Pineview Estates restricts residential uses to the front 200 feet of the lot. The <br />proposed structure will have a 41 foot front yard, 50 and 59 foot side yard and 874 rear yard <br />setback. The location of the structure leaves a 132 foot deep rear yard before approaching that part <br />of the lot reserved for commercial use. <br /> <br /> <br />
