This Paragraph 1 provision should not be changed for state <br />or federal campgrounds, and should only be changed for other specific <br />types of governmental campgrounds if your City Attorney has advised you <br />that the City has permitting authority over other governmental units. <br /> <br />Subd. 2, Item 11. Should Essential Services also be considered a <br />conditional use in the Urban Area in 9.23.05, Subd. 17 Other comments <br />below. <br /> <br />Subd.' 1, Item 7 and Subd. 2, Item 7. The City may <br />choose m be more restrictive than this maximum and may choose not to <br />exempt agn-icUltural buildings, but the Commissioner could not certify a less <br />restrictive provision than what the rules allow. <br /> <br />Subd. 2, Item 1, Non-Riparian lots - did you mean to also strike out 4, in <br />addition to striking out 2 1/27 <br /> <br />Subd. 3.1. Trott Brook is located within the area of the City of Ramsey <br />that is subject to the requirements of MN Rules, parts 6105.0010 - <br />6105.0250, as per the Rum River Rale, part 6105.1470, subp. 5. Therefore, <br />Trott Brook, as a designated tributary, has a minimum setback of 100 feet <br />under MN Rules, part 6105.0110, subp. 3, item B, whether it is in an <br />unsewered or sewered area. If you feel that there may be confusion since <br />Trott Brook is affected by both this ordinance and the Shoreland <br />ordinance, I would suggest the following wording: <br /> <br />Subd. 3 Trott Brook is a designated tn'butary of the Rum River and the <br />following setbacks shall also apply in Section 1, Township 32 North, Range <br />32 West as part of the Scenic River Land Use District: <br /> <br />Building Structure setback from the ordinary high water level <br />of Trott Brook ia-.a~-unse, wo~:od.~roa - 100 feet~-ha--a--se,~:od <br />ar~a---50:~[~t.. (These last strikeouts are fbr clarification only <br />and would n.ot be'retained in the proposed ordinance <br />amendment since they were never part of the adopted <br />ordinance under consideration.) <br /> <br /> [and retain 2. and 3. correctly as written] <br /> <br />Subd. 3. Sinceyou have chosen to place Essential Services as part of <br />Section 9.23.05, Subd. 2, Item 18, Utility Transmission lJirtes which requires <br />adherance to the standards in Sec. 9.23.10, Subd. 3 and MN Rules, part <br />6105.0180, do you also want essential services to be subject to MN Rules, <br />part 6105.01807 These rules provide some excellent '"oest management <br />guidelines" for minimizing adverse effects and I would highly recommend <br />you consider these for essential services also. If so, the following wording <br />should be changed to meet your change in Sec. 9.23.05: <br /> <br /> <br />
