18. <br /> <br />All costs:incurred by the City in executing and administering this permit shall be the <br />responsi~lity of the permit holder. The permit holder shall maintain a minimum Five <br />Hundred Dollar ($500.00) balance in an escrow account with the City. This escrow shall <br />be used trJ reimburse the City for expenses incurred in the administration of this permit. At <br />the time the mining operation and site restoration are completed to the satisfaction of the <br />City, the balance of the escrow shall be returned to the Permit Holder. <br /> <br />19. <br /> <br />The haulroute for the excavated material shall be from the site through undeveloped <br />portions Sf Northfork 5th and the Links golf course westerly to the raikoad tracks, then <br />southerlyialong the raikoad tracks to 153rd. No portions of paved city streets shall be used <br />except foe the portion of 153rd Avenue between the railroad tracks and T.H. #10. <br /> <br />20. <br /> <br />21. <br /> <br />All gradirjg operations shall be conducted between 6:30 a.m. and 8 p.m. on weekdays only <br />unless ott/erwise specifically approved by the City Administrator and/or his designee. <br /> <br />The amotlnt of dust or other particulate matter caused by the mining operation shall not <br />exceed th{ standards established by the Minnesota Pollution Control Agency. No operation <br />shall be allowed when wind gust exceed 30 miles per hour. <br /> <br />22. <br /> <br />All operations shall comply with all applicable Minnesota Pollution Control Agency <br />regulation!s and Federal and Environmental Protection Agency regulations for the protection <br />of water quality. <br /> <br />23. <br /> <br />All haul rOads are subject to the approval of the City Engineer. While hauling operations <br />are in pro~ess, the permit holder shall maintain the haul road in a condition satisfactory to <br />the City tSngineer. When hauling operations are completed, the permit holder shall either <br />restore th,t haul road to a condition at least equal to that which existed at the time the <br />hauling operations were started, or compensate the local road authority in an amount <br />satisfactory to that road authority and concurred in by the City Engineer for the restoration <br />of that haul road. The City Engineer will then accept such restoration or concur in such <br />financial ~ettlement for the restoration of the haul road in writing and such acceptance will <br />relieve th~ permit holder of any additional obligation in connection with the restoration of <br />the haul roads. If the permit holder fails or refuses to perform haul road restoration or to <br />make satisfactory financial settlement for such restoration, the City will cause the <br />restoratioi~ work to be done and require reimbursement from the financial guarantee <br />required herein. <br /> <br />The motion for adoption .of the foregoing resolution was duly seconded by Councilmember <br /> and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same <br /> <br />and the following abstained <br /> <br />and the following Were absent <br /> <br />whereupon said resolution was declared duly passed and adopted by the Ramsey City Council this <br />the ~ day of . ,1995. <br /> <br />North Fork, Inc., :hereby acknowledges receipt of this permit and that they have reviewed the <br />conditions of this permit and have agreed that they will comply with the terms of this permit. <br /> <br />q7 <br /> <br /> <br />
