Environmental protection § 9.21 <br /> <br />9.21.0 3 Diefinitions. For the purpose of this section, certain terms or words used herein <br />shall be interpreged as follows: The word "shall" is mandatory, not permissive. All distances <br />unless otherwise ~;pecified shall be measured horizontally. <br /> <br /> i. Bluffline for the Critical Area Overlay District: T-he A line which <br />...... '-, ~'^" .... "~'*'~-~ .... *'~,,~-'~ along the top of the slope connecting the points at <br /> pi/ e~^~ (more than 12 percent) tc, .... *~ ~ ~ ....... ~ <br />which the slo becomes ck,~nge~ ..... steep ~0 ,, ..... v,- ...... ~. <br /> <br /> Bluff for the Shoreland Overlay District: A topographic feature such <br />as a hill, cliff,~ or embankment having all of the following characteristics: <br /> <br /> a. part or all of the feature is located in a shoreland area; <br /> <br /> b.' the slope rises at least 25 feet from above the ordinary high water <br />level of the waterbody; <br /> <br /> c.; the grade of the slope from the toe of the bluff to a point 25 feet <br />or more above~the ordinary high water level averages 30 percent or greater; and <br /> <br /> d. the slope must drain toward the waterbody. <br /> An area with an average slope of less than 18 percent over a distance <br />for 50 feet or more shall not be considered part of the bluff. <br /> <br /> BOathouse A structure used solely for the storage of boats or boating equipment. <br /> BOilding Line The line measured across the width of the lot at the point where <br />the principal stmature is placed in accordance with setback provisions. <br /> <br /> Clear-cutting The removal of an entire stand of u'ees. <br /> <br /> COnditional Use A use of shorelands which is permitted within a zoning district <br />only when allowdd by the city after a public hearing, if certain conditions are met which eliminate <br />or minimize the ificompatibility of the conditional use with other permitted uses of the district. <br /> Crown Cover The ratio between the amount of land shaded by the vertical <br />protection of the! branches and foliage area of standing trees to the total area of land, usually <br />expressed as percentage. <br /> <br /> Development The conswuction, installation or alteration of any structure, the <br />extraction, grading or filling, clearing or other alteration of terrestrial or aquatic vegetation, land or <br />the course curren[ or cross section of any water body or water course or the division of land into <br />two or more parcels. <br /> <br /> Di~mensional Requirement Minimum and maximum setbacks, yard <br />requirements on,or structure height or size restrictions established in Chapter 9.01 for the various <br />zoning districts. <br /> <br /> Emergency Work Work that is necessary to save life or property. <br /> <br /> Governing Body The Council by whatever name known. <br /> Hardship A hardship means the property in question cannot be put to reasonable <br />use under the conditions allowed by the official controls; the plight of the landowner is due to <br />circumstances unique to their property, not created by the landowner;, and then if granted, will not <br />alter the essentialicharacter of the locality. Economic considerations alone shall not constitute a <br />hardship if a reasonable use for the property exists under the terms of the official controls. <br /> Li~ter Slightly decomposed organic material on the floor of a wooded area. <br /> <br /> Lot A parcel ef land designated by metes and bounds description, registered land <br />survey, auditors plot, or other accepted means and separated from other parcels or portions by said <br />description for tlle purpose of sale, lease, or separation thereof.
