Environmental protection § 9.21 <br /> regulations, a lot shall be considered to be an individual building site which shall be occupied by <br /> no more than one principal structure equipped with sanitary facilities. <br /> <br /> Nonconforming Use Any use of land established before the effective date of <br /> this Section which does not conform to the use restrictions of a particular zoning district. This <br /> should not be confused with substandard dimensions of a conforming use. <br /> <br /> Ordinary High Water Mark A mark delineating the highest water level which <br /> has been maintained for a sufficient period of time to leave evidence upon the landscape. The <br /> ordinary high water mark is commonly that point where the natural vegetation changes from <br /> predominantly aquatic to predominantly terrestrial. For watercourses, the ordinary high <br /> water mark is the elevation of the top of the bank of the channel. <br /> <br /> Person Any individual, firm, corporation, partnership, association or other <br /> private or governmental entity. <br /> <br /> Planned Cluster Development A development considered to be a type of <br /> Planned Unit Development and is subject to the same review criteria. <br /> <br /> Planned Unit Development A type of development which may incorporate a <br /> variety of land uses planned and developed as a unit. The Planned Unit Development is <br /> distinguished from the traditional subdivision process of development in that zoning standards <br /> such as density, height limits, and minimum lot sizes may be altered by negotiation and agreement <br /> between the developer, the City and the Commissioner of Natural Resources. <br /> <br /> Protected Waters* Any waters of the State as defined in Minnesota Statutes, <br /> ]rlgn..~u~.,. §ln~ '1"~.,~.~..,,, ~.,..,....o..~.e"*'~;";~':~'n .-~1~ section 103G.005, subdivisions 15 and 18. However, <br /> no lake, pond or flowage of less than ten acres in size and no river or stream having a total <br /> drainage area less than two square miles shall be regulated for the purposes of these regulations. <br /> <br /> Setback The minimal horizontal distance between a structure or sanitary facility <br /> and the ordinary high water mark, bluffline, or top of a bluff, or between a structure or <br /> sanitary facility and a road, well, highway, or property lines. <br /> <br /> Shoreland Land located within the following distances from protected waters: <br /> <br /> a. 1,000 feet from the ordinary high water mark of a lake, pond, or <br /> flowage; and <br /> <br /> b. 300 feet from a river or stream, or the landward extent of a flood plain <br /> on such rivers or streams, whichever is greater. The practical limits of <br /> shorelands may be less than the statutory limits where such limits are <br /> designated by natural drainage divides at lesser distances, as shown on <br /> the official zoning map of the City. <br /> <br /> Sign, Advertising A sign which directs attention to a business, commodity, <br />service, activity or entertainment not necessarily conducted, sold or offered upon the premises <br />where such sign is located. <br /> <br /> Slope The inclination of the natural surface of the land from the horizontal, <br />usually measured in one of three ways: t) as a ratio, the horizontal distance to the vertical distance; <br />2) as a percentage, the vertical distance over the horizontal distance; and. 3) by degrees, measured <br />from the horizontal to the vertical. - ' ' <br /> <br /> Steep Slope: Means. land where agricultural activity or development <br />is either not recommended or described as poorly suited due to slope steepness <br />and the site's soil characteristics, as mapped and described in available county <br />soil surveys or other technical reports, unless appropriate design and construction <br />techniques and farming practices are used in accordance with the provisions of <br />these regulations. Where specific information is not available, steep slopes are <br />lands having average slopes over 12 percent, as measured over horizontal <br />distances of 50 feet or more, that are not bluffs. <br /> <br />75} <br /> <br /> <br />
