Administrator at least ten (10) days prior to the day of the hearing to each owner of affected <br />property and prol~erty situated wholly or partly within 350 feet of the property to which the <br />amendment relate,S. For the purpose of giving mailed notice, the Zoning Administrator may use <br />any appropriate r{cords to determine the names and addresses of owners. The failure to give <br />mailed notice to individual property owners, or defects in the notice, shall not invalidate the <br />proceedings, prov!ded a bona fide attempt to comply with this Section has been made. <br /> <br /> Subd. 6. Iff after any public hearing upon an amendment, the proposed <br />amendment is revised or further revised to include land previously not affected by it, the <br />Planning CommiSsion shall hold another public hearing, pursuant to public notice, before <br />proceeding to vot6 on the amendment. <br /> <br /> Subd. 7. The Council shall review the Commission's action and shall act upon <br />the request in accordance with State Statue. <br /> <br />9.03.04 Conditio~nal Rezonings. <br /> <br /> Subd. 1. Purpose. The purpose of conditional rezoning is to formalize <br />development standards to ensure consistency and compatibility with surrounding land uses and <br />neighborhoods. <br /> <br /> Subd. 2. Procedure. The procedure for changing zoning district boundaries <br />(rezoning) shall be' as follows: <br /> <br />Execution of a Conditional Rezoning Agreement ("CRA") recorded with <br />the subject property shall be compulsory for all rezonings to multiple family <br />commercial, and/or industrial districts, including the following: <br /> <br />R-2 Medium Density Residential District <br />R-3 High Density Residential District <br />B-1 General Business District <br />B-2 Highway Business District <br />E-1 Employment District <br />E-2 Employment District <br />P Public Facilities District <br />PUD Planned Unit Development District <br /> <br />Subd. 3. Standards: The following shall be included in the CRA: <br /> <br />Agreement to layout, develop and maintain the subject property as <br />presented in the accompanying preliminary plat or site plan. <br /> <br />Provision to allow the City Council to commence rezoning of the <br />subject property to the previous zoning district if the preliminary plat <br />or site plan is not adhered to. Said zoning change shall not be <br />contested by the subject property owner or parties to CRA. <br /> <br />Additional standards may be included to protect the health, safety, <br />and general welfare of surrounding land uses. <br /> <br />18 <br /> <br /> <br />
