Su~bd. 5. Additional Deposits After Submittal. If at any point during the <br />processing of a zoning or land use application, the actual or estimated processing costs exceed <br />the amount on escrow, the applicant shall have ten (10) days to supply an additional escrow in an <br />amount equal to or' greater than the estimated processing costs. <br /> <br /> Subd. 6. Refund of Unused Deposits. Any portion of those funds <br />deposited in escrow but not expended or encumbered shall be returned to the applicant after final <br />action on the application. Under no circumstance shall an escrow be considered an interest <br />bearing account. <br /> <br />9.03.03 <br /> <br />Zoning Amendments. <br /> <br /> Subd. 1. Purpose. The City Council may adopt amendments to the Zoning <br />Ordinance and zohing map in relation both to land uses within a particular district or to the <br />location of the diatrict lines. Such amendments shall not be issued indiscriminately, but shall <br />only be used as a means to reflect changes in the goals and policies of the community as <br />reflected in the Plan or changes in conditions in the City. The Council may amend this Chapter <br />as proposed by a inember of the Council, Planning Commission, or by a petition of a person <br />residing or owning property within the City, in accordance with the following provisions. <br /> <br />Sul~d. 2. Type of amendments: <br /> <br />a. Change in district's boundary; <br /> <br />b. Change in district's regulations; <br /> <br />c. Change in any other provision of this Chapter. <br /> <br />Subd. 3. Required exhibits: <br /> <br />a. Boundary line survey; <br /> <br />b. General development plan showing the proposed use-of the property~ <br /> <br /> c. Other information as required by staff. <br /> <br /> Subd. 4. Procedure. Applications for zoning amendment shall be filed with the <br />Zoning Administrator and the applicant, shall pay an application fee and a escrow deposit in <br />accordance with a ~chedule annually affixed by resolution. When the Zoning Administrator has <br />determined that the application is complete, it shall be forwarded to the Planning Commission <br />for review. <br /> <br /> Subd. 5. Before voting on the enactment of an amendment, the Planning <br />Commission shall ihold a public hearing thereon, pursuant to public notice. It shall be the <br />responsibility of the Zoning Administrator to have notice of the time, place, and purpose of the <br />public hearing pub~lished in the official city newspaper prior to the hearing. Also, when an <br />amendment involves changes in district boundaries affecting an area of twenty (20) acres or less, <br />a written notice of the hearing stating its time, place, and purpose shall be mailed by the Zoning <br /> <br />17 <br /> <br /> <br />
