Allow a reasonable time, not to exceed 60 days for the performance of <br />any act required. <br /> <br />Be served upon the owner, agent, operator or occupant. Such notice <br />shall be deemed to be properly served if a copy thereof is: <br /> <br />(a) served personally upon said owner, agent or occupant; <br /> <br />(b) sent by certified mail to the last known address of the owner, <br /> agent, operator, or occupant; or <br /> <br />(c) <br /> <br />upon failure to serve the Compliance Order through a) or b) <br />above, said Order will be posted at a conspicuous place in or <br />about the affected dwelling unit. <br /> <br /> Sub, d. 3. Penalties. Failure to meet the requirements of the Compliance <br />Order shall be a 9iolation of this Section and a misdemeanor and is subject to all penalties as <br />provided by State~ Statute. Each day the violation continues in existence shall be deemed a <br />separate violation.: <br /> <br /> Sul~d. 4. Execution of Compliance Orders. Upon failure to comply with a <br />Compliance Order; within the time set and no appeal having been taken, the Council may, by <br />resolution, cause t~e cited deficiency to be remedied as set forth in the Compliance Order. The <br />cost of such remedy shall be levied against the subject property and may be levied and collected <br />as a special assessment in the manner provided by City Charter. <br /> <br /> Sul~d. 5. Appeal. When it is alleged by any person to whom a Compliance <br />Order is directed ~that such Compliance Order is based upon erroneous interpretation of this <br />Section, such person may appeal the Compliance Order as set forth in Chapter 9 entitled Zoning <br />and Subdivision of Land, Section 9.03.09 "Administrative Appeals" of the Ramsey City Code. <br />The filing of an appeal shall stay all proceedings, unless such a stay would cause imminent peril <br />to life, health, safety or property. <br /> <br /> Sub~l. 6. Emergency Cases. When a violation of this Section constitutes an <br />imminent peril to llfe, health, safety or property, the City may require immediate compliance and <br />if necessary take appropriate action to correct the violation. <br /> <br /> Sub~l. 7. Restrictions on Transfer of Ownership. The owner of any <br />building, or any pa~ thereof, upon whom a pending Compliance Order has been served, may not <br />sell, transfer, mortgage, lease, or otherwise dispose of the building or any part thereof, to another <br />person until the provisions of the Compliance Order have been complied with, unless such owner <br />shall furnish to th~ grantee, lessee, or mortgagee a true copy of any notice of violation or <br />Compliance Order ~nd shall obtain and possess a receipt of acknowledgement. Anyone securing <br />an interest in the building, or any part thereof, who has received notice of the existence of a <br />violation or Compliance Order shall be bound by such violation or Order without further service <br />of notice and shall be liable for all penalties and procedures provided by this Chapter. <br /> <br />19 <br /> <br /> <br />
