AI'TDRN~'Yll AT CAW

February 17, 1993

Mr. and Mrs. Ronald Jerich
Ramsey, MN 55303

Dear Mr. an~ Mrs. Jerich:

When Ru~ River Hills was developed by Dr. Tom Anderson and
myself, it was done as a "Planned Unit Development" (PUD) Under
the City's PUD ordinance. This means that a variety of land uses
(residential/ commercial, recreational) were created, and the
development Was done in phases. One of the yet uncompleted
phases concerns a 3.~ acre tract (Outlot C) which lies south
of the third ~fairway. and just north of where 169th Avenue meets
Iodine Street.

This tract was approved for higher-density multiple-family
housing to be developed when central sewer and water became
available. T~e lot was laid out to accomodate a'single.row'
of condominiums or apartments along the third fairway, served
by a single p~ivate access road. About A0 condominiums or apart-
ments could b~ constructed on this parcel.

In the pa:st year we began exploring the possibilties of
developing thi~ parcel using a private sewer and water system.
However, in bringing the subject up to some of the residents,
we heard widespread opposition to the concept of multiple-
family dwellings. Some people indicated that they were not
even aware tha~ this parcel had received approval for this usage,
even though that information has been public knowledge since
!984.

We have held this property for nine years, paid the taxes,
and the condominium plan was an integral part of our overall
expected returns. The retail value of an approved condominium
plat would be s~mewhere in the area of $600,000. %t is apparent
to us, however,~that whether we use a private treatment plant,
or wait for the metro sewer line to be extended this far north,
many of the neighbors will still object to the idea. However,
we have alreadyiperformed our end of our arrangement wi~h the
City. .We donated the land for the golf course to the City~ and
the City in turn was able to reconvey it to the Golf Course oper-

CIVIL 'tRIAL SP'£CIALI.~?
