Couadlmember Beyer inuoduced the following resolufioa and moved for its adoption: <br /> <br />RESOLUTION g93-06-I23 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT TO DANNY'S TRANNY'S, INC., AND DECLARING TERMS OF <br />SAME. <br /> <br /> WHEREAS, Daniel Karst, .tr. of Danny's Tranny's, Inc., has properly applied for a <br />conditional use p~a~it on the properly legally desmSbed as follows: <br /> <br />Lots 2, 3, and 4, Block 4, Gateway North Industrial Park Plat #2, Anoka Count),, <br />Minnesota (Subject Property); and <br /> <br /> Irvl-IEREAS, the Planning and Z, orfing Commission met on June 1 and June 7, 1993, <br />conducted the public hearing ~.nd recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact 4~)339, a conditional use permit to disassemble engines and <br />transmissions and conduct wholesale operations is hereby granted to Daniel Karst, Jr., <br />Danny's Tranny's, Inc., hereinafter referred to as "Permit Holder". <br /> <br />This permit shall rcm in effect so long as the conditions imposed herein are compiled <br />with. <br /> <br />Noises ernana~g from the sim and operations shall be in compliance with and regulated by <br />the State of Minnesota Pollution Control Sr. andm'ds, Minnesota Rules 7010.0010 to <br />7010.0080, as amended or except as modified herein by City performance requirements. <br /> <br />The emission of odor from the operation shall be in ~oCnpliance with and regulated by the <br />State of Minnesota Pollution Control Standards, Mirmesora Rules 7005.0920, as amended <br />except as modified herein by City perforce requirements. <br /> <br />The City m~y order the Permit Holder to undertake corrective actions within specific rime <br />frames based on test results or evaluations to remedy pollution problems or nuisance <br />complaints. If the Permit Holder fails to take corrective action w/thin specified time <br />frames, it may be determined by the City Council to be a violation of the CUP and cause <br />for permit revocation. <br /> <br />Disassembly of engines and transmi.qsions shall be conduct~ wholly within a building and <br />in accordance with County, State and !=ederal rrxtuimmc,uts. <br /> <br />Ail liquid waste, waste solvents, cleansers, or wastewam' generaw, d from the disassembly <br />and cleaning of vehicle engines or transmi.~sions shall be collected and stored in ate. akproof <br />system in accordance w/th state and federal reg-~tions and then transported off site. Waste <br />fluids shall be stored inside the building in sum'dy, leakproof storage containers or tanks in <br />accord with MN Rules 7045.0526 or 7045.0528. The 'Permit Holder shall submit a copy <br />of the original shipping manifest and the completed manifest for h~:'-~rdous waste quarterly <br />to the City Zoning Administrator. A copy of the application submittal for a Hazardous <br />Waste Facility permit shall be subrnitzed to the City concurrently with submittal to Anoka <br />County and MPCA. A copy of the final permit, if approved, shall be transmitted to the <br />City within five days of receipt. <br /> <br /> <br />
