20. <br /> <br />21. <br /> <br />22. <br /> <br />23. <br /> <br />The placement, design and construction of new structures or additions to existing structures <br />and site improvements shall comply with City Code and applicable state codes and OSHA <br />requirements. <br /> <br />Thc Permit Holder agrees to connect.to City s~wcr and w~cr at the time sewer and water is <br />extended to the area and herein agrees to join in a petition for such improvements when <br />such petitions are prcscntcxL <br /> <br />In the event this CUP is revoked or the Permit Holder closes operation of the facility for <br />an), reason, including but without limitation, by order of the court or other agency of <br />competent jurisdiction, bankruptcy, insolvency, or abandonment, the Permit Holder shall <br />immediately proceed to remove all materials from the site, In the event the Permit Holder <br />fails to comply with the terms of this CUP, the City may, upon 30 days' written notice to <br />the Permit Holder, enter into the property and perform all such obligations, the costs of <br />which shall be borne by the Permit Holder or, in default thereof, by its surety. <br /> <br />Danny's Tranny's, Inc. shall submit financial assurances as follows: <br /> <br />(a) <br /> <br />Charges and Fees. Danny's Trarmy's, Inc. agrees to pay to the City upon the <br />issuance of this CUP a fee in an amount sufficient to reimburse the City for <br />engineering, legal and aflmirfistrative expenses reasonably incurred during the <br />consideration and development of this CUP. The Permit Holder shall maintain a <br />minimum balance of Five Hundred Dollars ($500.00) in the CLIP escrow account at <br />alt times for as long as the conditional use permit is in fome and shall reimburse the <br />City for all fees incurred by the City kn connection w/th inspection of the facility and <br />admin/strarion of this CLIP. <br /> <br />In the event the CiD' incurs additional reasonable costs occasioned solely by the <br />presence of this use within the City of Ramsey for personnel training, speciahzed <br />equipment, risk insurance or increased contract ,costs for providing f~re department <br />services, the Permit Holder agrees to reimburse the City. at cost upon presentation <br />of supporting documents and invoices consistent with applicable law. <br /> <br />(b) <br /> <br />Liabil/ty Insurance and Liability Indemnification. The Permit Holder shall secure <br />and maintaha insurance from an insurance company acceptable to the City. and <br />authorized to write casualty insurance in the State of Minnesota which will protect <br />the Permit Holder, its agents and employees and the City from claims for bodily <br />injury, death or property damage which may arise from the operations on the <br />Subject Proper'ry. The Permit Holder shall fie a certificate of/nsurance or a <br />certified copy of the insurance policy with the City. Such insurance policy shall <br />conm½n a clause providing that it shall not be cancelled by the insurance company <br />without thirty (30) days' written notice to the City of intention to cancel. The <br />following coverages shall be provided in ~mounts not less than those specified: <br /> <br />PubLic llabihty, general I/abihty, personal injury and property ct~mage: <br /> <br />(1) Inju.D' or death of one person - $1,000,000. <br />(2) Injury to more than one person in a single accident - $1,000,000. <br />(3) Property d~mage - $1,000,000. <br />(4) Total Aggregate LLabil/ty for all items $1,000,000. <br /> <br />ii. <br /> <br />Automobile and mack public liability personal injury and property _damage <br />including owned and leased vehicles: <br /> <br /> <br />
