COUNCIL BUSINESS: <br />PUBLIC HEARING <br />Case #I: Consider Compliance with <br /> 3 and 4, Block 4, Gateway <br /> of Danny's Tranny's <br /> <br />Conditional Use Permit for Lots 2, <br />North Industrial Park Plat 2; Case <br /> <br />Zoning Admi~snmtor~ Frolik stared that in May 1993, ~. Karst applied for a conditionM <br />use permit to ~lisasscmble engines and transmissions and conduct wholesale activities on <br />Lots 2, 3 and ,~ of Block 4, Gateway North Industrial Park Plat #2. The proposal included <br />the constructidn of a 12,500 square foot building to provide for an ali-enclosed operation. <br />Mr. Karst applied for a building permit that has been ready since October lg, 1993; <br />however, it c~not be released until Mr. Ka-~t provides the $46,680 financial guarantee for <br />site improvements called for in the Site Plan Development Permit. Ms. Frolik stated that <br />Mr. Karst's amended conditional use permit for Lot 1 and new conditional use permit for <br />Lots 2, 3 and 4,! seriously hinged on whether or not he brought Lot 1 into compliance with <br />his current CUP and cleaned up Lots 2, 3 and 4. He put forth the effort and received his <br />approvals. SinVe that time, he has resumed methods of operation that arc violations of this <br />CUP and allowed the condition of the premises on Lots 2, 3 and 4 to again dectine to a <br />toufl~y unacccprhble level. Ms. Frolik stated a drive-by inspection was done on December <br />6, 1993, and it Was apparent that clean-up efforts have been initiated; however, Lots 2, 3, <br />and 4 were not totally cleared of debris, inoperable vehicles and feedstock preparation <br />activity. She stated that this public hearing has been scheduled to take public comment in <br />the event City COuncil chooses to revoke Mr. Karst's permit. <br /> <br />Mayor GiIbertson closed the regular portion of the City Council meeting at 7:20 p.m. in <br />order to conduct the public hearing. <br /> <br />Mayor Gilbertson:called the regular portion of the City Council meeting back to order at <br />7:34 p.m. <br /> <br />Motion by Counci!~ember Beyer and seconded by Councilmember Peterson to direct Staff <br />to draft a findingsi of fact for Council's consideration pertaining to the conditiona~ use <br />permit issued to Danny% Tranny's for Lots 2, 3, and 4, Gateway North Industrial Park <br />Plat 2. ~ <br /> <br />Motion carried. VOting Yes: Mayor Gilbertson, Councilmembers Beyer, Peterson and <br />Hardin. Voting No: Councilmember Zimmerman. <br /> <br />Councilmember Zimmerman. agreed with what Mr. Hanson stated at the public hearing <br />about an industrial ar~a being just that; not a nursery. <br /> <br />NEW,. BUSINESS <br /> <br />Case ~2: <br /> <br />Adopt 1994 Tax Levy and General Fund Operating Budget <br /> <br />Finance Officer Hart stated that the 1994 Truth-in-Taxation public hearing was held on <br />Wednesday, Deeemb~ 1, 1993 at 7:00 p.m and now Council is required to adopt the levy <br />and budget. <br /> <br />Councilmember Hardig stated he is not real happy with the overall rate increase and added <br />that a good job had beeh done in the past to keep the levy down. <br /> <br />City <br /> <br />Council/December 14, 1993 <br /> Page 4 of 15 <br /> <br /> <br />
