Councilmember Beyer intnxiuced ~e following resolution a~l moved for im ~topfion: <br /> <br />RESOLUTION g93-06.123 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE <br />PERMIT TO DANNY'S TRANNY'S, INC., AND DECLARING TERMS OF <br />SAME. <br /> <br /> WHEREAS, Daniel Karst, Jr. of Danny's Tranny%, Inc., has properly applied for a <br />conditional use permit on the l:rroperty legally describe~ as follows: <br /> <br />Lots 2, 3, and 4, Block 4, Gateway North Industrial Park Plat #2, Anoka Count3', <br />Minnesota (Subject Property); and <br /> <br /> WHEREAS, the Planning and Zoning Commission met on June 1 and June 7, 1993, <br />conducted the public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact g0339, a conditional use permit to disassemble engines and <br />transmissions and conduct wholesale operations is hereby granted to Daniel Karst, Jr., <br />Danny's Tranny's, Inc., hereinafter referred to as "Permit Holder". <br /> <br />This permit shall remain in effect so long as the conditions imposed herein are complied <br />with. <br /> <br />Noises emanating from thc site and operations shall be in compliance with and regulated by <br />the State of Minnesota Pollution Control Standards, Minnesota Rules 7010.0010 to <br />70t0.0080, as mended or except as m:xdified herein by City performance requirements. <br /> <br />The emission of odor from the operation shall be in compliance with and regulated by the <br />State of Minnesota Pollution Control Standards, Minnesota Rules 7005.0920, as amended <br />except as modified herein by City performance requiremenm. <br /> <br />The City may order the Permit Holder to undertake corrective actions within specific t~me <br />frames based on test results or evaluations to remedy pollution problems or nuisance <br />complaints. If the Permit Holder fails to take corrective action within specified time <br />frames, it may be determined by the City Council to be a violation of the CUP and cause <br />for permit revocation. <br /> <br />o <br /> <br />Disassembly of engines and transmissions shall be conducted wholly within a building and <br />in accordance with Count3', State and laederal requirements. <br /> <br />All liquid waste, waste solvents, cleansers, or wastewater generated from the disassembly <br />and cleaning of vehicle engines or nxnsmi.~siorm shall be collected and stored in a leakproof <br />system in accordance with state and federal regulations and then transported off site. Waste <br />fluids shall be stored inside the building in sturdy, leakproof storage containers or tanks in <br />accord with MN Rules 7045.0526 or 7045.0528. The Permit Holder shall submit a copy <br />of the original shipping manifest and the completed manifest for hazardous waste quarterly <br />to the City Zoning Adm½nSsrmtor. A copy of the application submittal for a Hazardous <br />Waste Facility permit shall be submitted to the City concurrently with submittal to Anoka <br />County and MPCA. A copy of the final permit, ff approved, shall be transmitted to the <br />City within five days of receipt. <br /> <br /> <br />
