COUNCIL <br /> <br />PUBLIC <br /> <br />Case #1: <br /> <br />]~USINE$S: <br /> <br /> HI~ARING <br /> <br /> Consider Compliance with Conditional Use Permit for Lots 2, <br /> ~ and 4, Block 4, Gateway North Industrial Park Plat 2; Case <br /> Of Danny's Tranny's <br /> <br />Zoning Admi~strator Frolik stated that in May 1993, Mr. Karst applied for a conditional <br />use permit to ~sassemble engines and transmissions and conduct wholesale activities on <br />Lots 2, 3 and `4~f Block `4, Gateway North Industrial Park Plat #2. The proposal included <br />the consn'uctio~ of a 12,500 square foot building m provide for an all-enclosed operation. <br />Mr. Karst applied for a building permit that has been ready since October 18, 1993; <br />hpw.cver, it cannot be released until Mr. Karst provides the ,$46,680 financial guarantee for <br />rote :mprovemo~ts called for in the Site Plan Development Permit. Ms. l~rolik stated that <br />Mr. Karst's amended conditional use permit for Lot 1 and new conditional use permit for <br />Lots 2, 3 and 4,!seriously hinged on whether or not he brought Lot 1 into compliance with <br />his current CUP and cleaned up Lots 2, 3 and ,4. He put forth the effort and received his <br />approvals. Sind} that time, he has resumed methods of operation that arc violations of this <br />CUP and alloWt, zl the condition of the premises on Lots 2, 3 and `4 to again decline to a <br />totally unaccep~ble level. Ms. Frolik stated a drive-by inspection was done on December <br />6, 1993, and it Was apparent that clean-up efforts have been initiated; however, Lots 2, 3, <br />and 4 were not,totally cleared of debris, inoperable vehicles and feedstock preparation <br />activity. She stated that this public hearing has been scheduled to take public comment in <br />the event City ~_,ouncil chooses to revoke Mr. Karst's permit. <br /> <br />Mayor Gilberts0n closed the regular portion of the City Council meeting at 7:20 p.m. in <br />order to conduc~ the public hearing. <br /> <br />Mayor Gflbensgn called the regular portion of the City Council meeting back to order at <br />7:34 p.m. f <br /> <br />Motion by Coun~ilmember Beycr and seconded by Councilmember Pemrson to direct Staff <br />to draft a fmdir~gs of fact for Council's consideration pertaining to the conditional usc <br />permit issued t6 Danny's Tranny's for Lots 2, 3, and `4, Gateway North Industrial Park <br />Plat 2. t <br /> <br />Motion carried. ! Voting Yes: Mayor Gflbertson, Councilmembers Beyer, Peterson and <br />Hardin. Voting ~o: Councilmember Zimmerman. <br /> <br />Councilmember ~immerman agreed with what Mr. Hanson stated at the public hearing <br />about an industrial area being just that; not a nursery. <br /> <br />NEW BUsINEss <br />Case g2: Atlopt 1994 Tax Levy and General Fund Operating Budget <br />Finance Officer ~art stated that the 1994 Truth-in-TaXation public hearing was held On <br />Wednesday, December 1, 1993 at 7:00 p.m. and now CoUncil is required to adopt the levy <br />and budget. <br /> <br />Councilmcmber ~_~. din stated he is not real happy with the overall rote increase and added <br />that a good job h~ been done in the past to keep the levy down. <br /> <br />City <br /> <br />Council/December 14, 1993 <br /> Page 4 of 15 <br /> <br /> <br />
