P. 3/5

January 26, 1993

William Goodri:h
k~:orney at Law
Pou,--:h Avenne
· moka, ~N 55303

Dear Rill:

Several months ago I copied you wi~h some correspondence I had
sent to Sylvia Prolik concerning our contemplated plan'to replat
Outlo~ C and Lot l, Rlook 2, of Rum River ~il!s to accommodate
six 2-uni~ townhomes on the 4.6 acres. Sylvia responded and
indicate~ t-~o main conee_~-ns: Met Council reaction, and the"
preceden:'~hat'wou!d be set. i have sui~mitted ~he proposal
.Ln~ormal!y to the'Me~ Council and will be meeting ~-i~h. Sytvia
shortly ~o go ovar-'~hat area.

The matter of precedent, however, will likely involve you, and I
wanted to bring out several of the unique characteristics of.our
re.cues=. I do not believe that there is another ar~a of Ra~sey
that would meet all of the cri%eria needed to establish any
unfavorable precedent.

It is ~portanu to remember that we are not dealing with a 4.6
acre parcel. We are dealing with one phase of a 150+ acre
project, and we are simply amending =he-land use !or one phase -
the Multiple Family housing phase, which we are e!i~inating in
~avor of single-lami!y housing.

2. Ordinance Beinc Used

I= must also be r~ered that ~his proJec= is no__~t being done
under the s~b~ivision ordinance, but rather under the PUD
ordinance.. ' .~o.~ any'subsequen~ developer to . cla~ =he rich=_ %o
the same =~a~ment, he-would have to be under a PUD of sJ_~ilar
scope and size-.

t CIVIL TRIAL

Cr"RTIFI'~D BY THr' MINNr'e'~TA
