Motion by Comm~ioner Deemer and ~conded by Commlssioner Holland to recommend that City <br />Coundl approve ~e r~vised pre~ plat for Chestnut HilL <br />Discussion: City ~.ngineer Jankowski stated the~ is a drainage and utility easement n~¢ssary on <br />Lots 3 and ,~ in ~e northeast cul-de-sac. Commissioner D~emer stated he was in favor of the <br />second outlet to ne north. <br /> <br />Motion earned. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Henflriksen, Terr~~ and Thorud. Voting No: None. Absent: Commissioner LaDue. <br /> <br />~.--Case #2: <br /> <br />R~quest for Sketch Plan Review of Townhouses of Rum River Hills; <br />cage of Thomas Anderson and Wilbur Dom <br /> <br />Zoning Administrator Frolik stated the development agreement entered into for Rum River Hills in <br />1984 specified that Ouflot C was approved for development with multi-family housing at the time <br />sewer and water Iiecamc available, but it did not specify to what density. She noted there are plans <br />on file that indicaJre density was proposed at 5-10 units per acre for a total of 18 to 37 units. She <br />stated that the developers have submitmd a sketch plan for Townhouses of Rum River Hilk" which <br />is proposed to reE~at Lot 1, Block 2 and Ouflot C, Rum River Hills, into 12 townhouscs lots. The <br />12 units would b~ served by individual on-site septic systems and wells. She stated City Staff is <br />concerned that cli~regard of the 4 in 40 density policy commitment to the Metropolitan Council <br />would jeopardize ~e City's on-going efforts for a MUSA expansion. She stated that Metropolitan <br />Council feels it i~ inconsistent with the timing and sequencing of public facilities as indicated in <br />Ramsey's Comprehensive Plan. She added that Metropolitan Council is concerned about any <br />pollution problems resulting from development activity or inadequate management of private sewer <br />facilities and wo~ld hold the City of Ram.~ey fully responsible. Based on these concerns, City <br />Staff recommendS denial of the proposal to plat townhouse units in Rum River Hills at tl~s rime. <br /> <br />Applicant Wi.lbm'ii)om stated that the development agreement is nine years old and this is the tag <br />end of a i0 year ~oject. He explained that they agreed to build a golf course and construct roads, <br />donate the golf co~rse to the City matclng rates accessible to.the citizens, and develop ouflot C with <br />townhouses whe~ sewer and water b~ame available, lie stated that the agreement stares sanitary <br />sewer and wateri not City sewer and water, lie stated they are abundantly aware that the <br />neighbors, do .n°t Want ¢ondomirtinm.~. ... or apa~ u~enrs even.though the property is already, approved <br />for mulu-f~m~ly a~d that no variance ~s needed, lie explained that as a ¢omprormge, they c~me up <br />with townhomes like those in I-tam Lake. This will cut back on the density from 36 units to 12 <br />units, tie stated Some neighbors indicated that this is highly preferable to waiting for sewer and <br />water to come in ired something less desirable is developed, lie stated he sharply disagrees with <br />City Admini.~trat~ Schroeder and feels th~ was presented negatively to the Merropotkan Council. <br />He stated the Me .ttopolitan Council is very willing to work with this idea. He stated Mr. Schroeder <br />has not discussedithis with the City lawyer nor has a soil study been done yet. lie stated they are <br />aware they can't ~ ahead with the project until a sewer system is set up, but that the Planning and <br />Zoning Commi.~s%n needs to decide whether this is appropriam usage for this land at this point in <br />history, tie sugljested the Commission consider the concept of tOwrLhouses subject to certain <br />proposed conditions, thereby giving the city input into the design and size. lie stated that once a <br />sewer system is ~ place, the Commission could nor. prevent a developer from coming in and <br />building aparmaetRs when the neighborhood prefers lower density, lie requested the Commission <br />give the concept ~ chance to go through a public hearing. <br /> <br />Commissioner Thorud stated the Commission received a letter from Ronaid A. ~Ierich, dated <br />February 20, 1995 staring he was not in favor of townhouses and that thek real estate sign did not <br />show the townhortse layout when they were selling these other Iota. <br /> <br />Planning & Zoning Commission~4~6/93 <br /> Page 3 of 8 <br /> <br /> <br />
