Mr. Dom stated thc townhouses were not approved at that rime but that thc multi-family density <br />zoning has been of public record since 1984. <br /> <br />Commissioner Deemer refenva:l to Mr. 3erich's letter wherein Mr. Jm'ich stated he has had to have <br />his cesspool pumped four times in the last year, and Commissioner Deemer inquired whether this <br />was a failed system that the City should require to be replaaed. <br /> <br />Mr. Jankowstd stated the CiD' requires those reports to be filed with the CiD'. <br /> <br />Chairperson Bawden stated this was certainly worth looking into. He agreed with thc Metropohtan <br />Council in that certain items needed to be addressed but that the Commission should go forward <br />with the concept, and Commissioner Holland concurreck <br /> <br />Commissionez Deemer requested that Ms. F'rolik vcrkC3, the accuracy of the site location map for the <br />Rum River Hills P.U.D. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendrik~en to recommend City <br />Council approve the concept of a 12-unit townhouse development for Lot t, Block 1, and Outlot <br />C, Rum River Hills, subject to the following conditions: I) Demonstration that individual on-site <br />sewer systems can be accommodated according to applicable c~es; 2) Demonstration that adjacent <br />casement-area lands have sufficient available suitable soils to accommodate back-up drainfietd <br />areas for the 12 units; 3) Receipt of amended com.menLg from Metropohtan Council Staff; 4) <br />l:urther n:-4ew by legal counsel of the precedent wkich would be set by approval of this project; 5) <br />Water supply system to be approved by appropriate agencies; 6) The parry wall between units are <br />to be constructed of fire-proof material; 7) City staff receiving assurances from Metropohtan <br />Council that approval of the project will not endanger the possibility of any furore MUSA <br />expansions within the City. <br /> <br />Discussion: Commissioner Hendriksen stated although the City received a letter from the <br />Meu'opolitan Council saying they do not approve, Mr. Dom refutes that fact. Commissioner <br />Hendriksen stated it would be many years before me,topoi, iran sewer comes in, and he feels <br />uncomfortable approving this concept until these problems are resolveck Ms. Frolik stated the <br />Comm~.~sion could table approval until the items addressed are resolved. <br /> <br />Motion carried, Vol:Lug Yes: Char'person Bawden, Commissioners Deemer, Holland, Terry and <br />Tnomch VofingNo: CommissionerHendriksen.
