CASE # ,,~ <br />REQUEST FOB EXTENSION TO INSTALL REQUIRED SITE IMPROVEMENTS <br />AND WAIVER OF FINANCIAL GUARANTEE REQUIREMENT; <br /> CASE OF DALLES R.V. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />As you may rec , in thc Fall of 1992, Dalles R.V. was proposing to relocate from 7129 Hwy. <br />#10 N.W. to 7103~ Hwy. #10 N.W. At the time, conditional use permits were required for outside <br />display areas an~ outside display areas in addition to driveways and customer/employee parking <br />areas, were requb~ to be paved and curbed. In November of 1992, the City issued a conditional <br />use permit to Dal[es R.V. for the outside display area at 7103 Hwy. #10 N.W. The terms of the <br />conditional use permit required pavement and curbing, a deadline for installing the improvements <br />and a financial g~arantee ensuring the installation of the improvements, in accordance with City <br />Code. Accordingly, Mr. Dalles Notermann, owner of Dalles R.V., placed the financial guarantee <br />at the City in the ~rm of a letter of credit in the amount of $47,868.00, 150% of the estimated cost <br />of the improveme0ts, and the conditional use permit was issued. <br /> <br />Observations: <br /> <br />Mr. Noterrnann d~d not meet the October, 1993 deadline for installing the improvements. When <br />the expiration date~ on the letter of credit approached, the issuer was notified that the improvements <br />were not complet~ and the letter must be renewed. The issuer notified Dalles Notermann and his <br />daughter called to Iprotest the required site improvements and the required financial guarantee. At <br />that time, it was c ~clynmunicated that their options were to request an inspection of the improvements <br />installed to date to ~educe the amount of the financial guarantee to be provided, and in the meantime <br />request a Council extension to install the site improvements. It was never meant to be conveyed <br />that the letter of cr~Iit could lapse, but Dalles R.V. took no action to renew it, and it did expire. <br /> <br />Because of additic~.al improvements to be made to the building at 7103 Hwy. #10 N.W., Dalles is <br />requesting that the ~tne period for installing the required site improvements be extended from 1993 <br />to 1997 and that n~ financial guarantee be required. Dalles is willing to let his Motor Vehicle Sales <br />license serve as hisicommitment to complete the required site improvements. <br /> <br />In recent years, the Council has held steadfastly to requiring the installation of the required site <br />improvements and providing financial guarantees. <br /> <br />The following items are enclosed for your review: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site~location map <br />Apti~roved site plan <br />Cor~_ditional Use Permit <br />Let/er from Dalles R.V. dated January 11, 1994 <br /> <br />Recommendation: <br /> <br />It is important for ~e City to preserve its credibility in this case in recognition of those commercial <br />developments that _~ave come before you in the past that were made to comply with requirements <br />and those commercial developments that will come to you in the future from which you will desire <br />the same pefform~rice standards. <br /> <br />q/ <br /> <br /> <br />
