Councfln~mber ~ introduced the following resolution and moved for its adoption: RESOLUTION g94-02- A RESOLUTION APPROVING THE ISSUANCE OF A TEMPORARY CONDITIONAL USE PERMIT FOR THE ESTABLISHMENT AND OPERATION OF AN ALTERNATE FUEL SUPPLY TEST DEMONSTRATION FACILITY, BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF SAME. WHERE~kS, Kaltec of Minnesota, Inc. has properly applied for a temporary conditional use permit on th~ property generally known as 14730 Sunfish Lake Blvd. N.W. and legally described as follows: The Sou~ one-half of the Southeast Quarter of Section 22, Township 32, Range 25, Anoka Count),, Minnesota_ ("Site) an& WHERE{kS, the Planning met on February 1, 1994 and conducted a pubhc hearing and recommended C'i~ Council approval of the request. NOW TI~EREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAIv~SEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Term. T~'s permit shall expire on February g, 1995. All structures, equipment, supplies, materials ~d operations residue shall be removed from the Site by sa.id expiration date. In the event Kaltec fails to comply with the terms of this CUP, the City ma),, upon seven (7) days' written notice, enter onto the property and perform all such obligations, the costs of which shal~, be borne by Kaltec or, in default thereof, .by irs surety. Noise and~Odor. Noises emanating from the site and operations shall be in compliance with and r~gulated by the State of Minnesota PoLlution ~onrroI Standards, Minnesota Regulatior~ MPC, as amended except as medified herein b> City requirements. Hours of Operation. The hours of operation of the test facility shall be permitted at 24 hours per ~dhy. Control og Operations. Operations must be conducted so as to minimize noise, sa-feB', odor, visuat~ impacts or other nuisance concerns to adjacent residential properties. :~3~-Site Fire Protection. Kaltec shall be responsible for any f~re suppression costs required at the facility. r Traffic. T~ck traffic shall utilize U.S. I-Iiahway-#10 and Sunfish Lake Boulevard N.W. (County Ro.'ad 57) exclusively when travelin~ to and from the facility.
