Drainage from the facility shall be directed to an existing sedimentation basin approx/mately 150 feet north of the test facilJq,,. Security. Site security shall be provided by an existing fence and gate. Closure Due to CUP Revocation, Other Circumstances. In the event this CUP is revoked pursuant to the terms herein or Kaltec pprematurely closes operation of the facility for any reason, including, but without limitation, order of the court or other agency of competent jurisdiction, bankruptcy, insolvency, or abandonment, Kaltec shall immediately proceed to remove all structures and equipment from the site. In the event Kaltec fa/is to comply with the terms of this CUP, the City may, upon 30 days' written notice, enter on to the property., and pc-'rform all such obligations, the costs of which shall be borne by Kaltec or, in default thereof, by its surety. Building Permits. No building permit shall be issued by the City until all materials, supphes and equipment relating to the fire processing facility formerly located on the Site have been removed from the property to thc sarisfactio of the City. No construction or placement of any s~'ucmres shall commence prior to the issuance of the applicable building permit by the CiD' Building Official. Scope and Conduct of Operations. The operations permitted by this CUP may be performed on the Subject Proper'vd in conformance with ex/sting statutory and regulatory authority and requirements of the City, Anoka Count)', Minnesota, and the M./nnesota Pollution Control Agency ("MPCA"). Financial Assurance. Kaltec shall submit financial assurances as follows: (a) Charges and Fees. Kaltec a~ees to pay to the City upon the issuance of this CUP, a fee in an amount sufficient to reimburse the CiD' for en~neering, legal and adminis~-ative expenses reasonably incurred during the consideration and development of ti'tis CUP. Kaltec shall reimburse the CiD, for ail administrative fees incurred by the City in connection with inspection of the operation and ~clmirfisrration of this CUP. In the event the City incurs additional reasonable costs occasioned solely by the presence of this use within the City for personnel training, specialized equipment, risk insurance or increased costs for providing f~re department services, Kaltec a~ees to reimburse the City at cost upon presentation of supporting documents and invoices consistent with appLicable law. (b) Liability Insurance and Liability Indemnification. Kaltec shall secure and m~nta/n insurance from an insurance company acceptable to the City and authorized to write casualty insu.m_nce in the State of Minnesota which will protect Kaitec, its agents and employees, and the City from claims for bodily in.jury, death or property d~rnage which may arise from the operations on the Site. Kaltec shall file a cerfi.ficate of insurance or a certified copy of the insurance potty with the City. Such insurance policy shall contain a clause providing that it shall not be cancelled by the insurance company without tt,.L~/(30) days' wr/rren notice to the City of intention to cancel. The following coverages shall be provided in mounts not less than those specified: ~ Public liabilit3,, general liability, personal injury and property rtarn~ge: (l) Injury or death of one person - $1,000,000... (2) Injury to more than one person in a single accident - $1,000,000. (3) Property, ct~mage - $1,t300,000.
