Councilmembcr i imroduced the following resolution and moved for its adoption: RESOLUTION A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT FOR AN ACCESSORY APARTMENT IN A SINGLE FAMILY STRUCTURE .~N THE R-1 RURAL RESIDENTIAL WHEREAS, Cathy Gustafson has properly applied for a conditional use permit ("Permit") to maintain an accessory apartment within the single family dwelling in the R-1 Rural Residential Dis~ct on thc property generally known as 15823 Nowthen Blvd. N.W. and legally described as follows: That pan ~)f the Southwest Quarter of thc Southwest Quarter of Section 14, Township 32, Kange 25i Anoka County lvSnnesota described as follows: Commencing at the Southeast corner of paid Southwest Quarter of the Southwest Quarter which point is the intersection of thc So~th linc of said Secdon 14 with thc ccnterlinc of County State Aid Highway No. 5; Thcnc~North 0 degrees 36 minutes 25 seconds West along said Centerhne a distance of 224.10 f ~.c~t; thence Northwesterly on a tangential curve to thc left having a radius of ,$42.92 fc,~t and having a delta angle of 37 degrees 57 miuutes 15 seconds for a distance of 293.40 fe~t; Thence North 38 degrees 33 minutes 40 seconds West along said centerline and tangefit to said curve a distance of 447.0 feet to the actual point ~ beginning of the tract of land to Be hereby described; Thence continuing North 38 degrees z3 minutes 40 seconds West alor~ said centerline a distance of 290.90 feet; Thence North 69 degrees 40 minutes 2.0 seconc[s East to its intersection .~w~,,'th the East line of said Southwest Quarter of the Southwes! WHEREAS, the Planning Commission met on February 1, 1994, conducted the pubhc hearing and recorrknended City Council approval of the request. NOW T~EREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAIV[~SEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. Based on ~indings of Fact # , a conditional use permit (the "Permit") for an accessory apartment y~ithin the single family dwelling unit is hereby granted to Cathy Gustafson, (the "Permit H¢lder"), at 15823 Nowthen Blvd. N.W. (the "Subject Property"). 2. That said ~ermit shall remain in effect so long as the conditions imposed herein are complied ~Fith and the property owner maintains residence in one of the two units on the Subject Pr_q>perry. 3. That the s ~ni~ucture exterior shall rn~intain the appearance of a single family dwelling unit. 4. That the s[Fucture shall not be further altered to render it marketable as a duplex or the accessory apartment as a condom~rfiurm 5.
