That the addition contains its own kitchen, living room, bedroom, and bathroom, all of <br />which are separated from the main living quarters by an atrium door, and its own furnace, <br />water heater and gas meter, and is therefore considered to be an accessory apartment by <br />CiD' Staff. <br /> <br />10. <br /> <br />That the Applicant has stated that thc accessory apartment has been utilized as such ever <br />since it was constructed in the 1970's and the Applicant continued this use when talcing <br />ownership of the dwelling unit in 1991. <br /> <br />I1. <br /> <br />That City Staff has determined that the homeowner responsible for constructing the <br />accessory apartment in the 1970~s never properly obtained a conditional use permit in <br />accordance with C/t3, Code and therefore the accessory apm anent is considered illegal non- <br />conforming. <br /> <br />I2. <br /> <br />That the main living quarters and accessory apartment were damaged by f-rre in 1993 and <br />upon inspection by Cit'), Staff, the Applicant was inform~ that a conditional use permit <br />must be obtained to bring the accesso~, aparrrnent into compliance with City Code. <br /> <br />13. <br /> <br />That the Applicant has submitted a petition signed by four (4) neighboring residents <br />indicating no objection to the added Ii'ring quarters. <br /> <br />14. "Fnat there are other similar permitted conditional uses in the single family district. <br /> <br />15.
