Mr. Dom stated the townhouscs were not approved at that time but that the multi-family density zoning has been of public record since 198,4. Commissioner Deemer referred to Mr. Jefich's letter wherein Mr. Jerich stated he has had to have his cesspool pumped four times in the last year, and Commissioner Deemer inquired whether this was a failed system that the City should require to be replaced. Mr. Jankowski stated the City requires those reports to be filed with the City. Chairperson Bawden stated this was certainly worth looking into. He agreed with the Metropolitan Council in that certain items needed to be addressed but that the Commission should go forward with the concept, and Commissioner Holland concurred. Commissioner Deemer requested that Ms. I::rolik verify thc accuracy of the site location map for the Rum River Hills P.U.D. Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recommend City Council approve the concept of a 12-unit townhouse development for Lot 1, Block 1, and Outlot C, Rum River Hills, subject to the following conditions: I) Demonstration that individual on-site sewer systems can be accommodated according to applicable codes; 2) Demonstration that adjacent easement-area lands have sufficient available suitable soils to accommodate back-up drainfield areas for the 12 units; 3) Receipt of amended comments from Metropolitan Council Staff; 4) Further review by legal counsel of the precedent which would be set by approval of this project; 5) Water supply system to be approved by appropriate agencies; 6) The party wall between units are to be constructed of fire-proof material; 7) City staff receiving assurances from Metropolitan Council that approval of the project will not endanger the possibility of any future MUSA expansions within the City. Discussion: Commissioner Hendriksen stated although the City received a letter from the Metropolitan Council saying they do not approve, Mr. Dom refutes that fact. Commissioner Hendriksen stated it would be many years before metropolitan sewer comes in, and he feels uncomfortable approving this concept until these problems are resolved. Ms. Frolik stated the Commission could table approval until the items addressed are resolved. Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, Terry and Thorud. Voting No: Commissioner Hendriksen. Absent: Commissioner LaDue. Commissioner Deemer inquired whether Mr. Dom understood he could not go to City Council until City Administrator Schroeder finds the conditions met, and Mr. Dom stated he understood. i I I I I I I I !
