The property owner shall be responsible for maintaining the <br /> premises. This shall include, but not be limited to, mmntaining an5, landscaping and <br /> keeping the premises free from litter and debris. <br /> <br /> Building Permits. No construction of any structures shall commence prior to the <br /> issuance of the applicable building permit by the City Building Official and the Site Plan <br /> Development Permit by the City Council. The Site Plan Development Permit shall not be <br /> considered issued until the property owner has provided the City with all financial <br /> guarantees required by the Permit and reimbursed the City for all costs incurred in <br /> processing the application for a conditional use permit and site plan approval.. <br /> <br />Site inspections. The City Adminisn'ator, or his designee, shall have the fight to inspect <br />the premises for compliance and safety purposes annually or at an5' time, upon reasonable <br />request. <br /> <br />Cost of Administration. The property owner shall be responsible for all City costs <br />incurred in adrmnistenng and enforcing th_is Conditional Use Permit. <br /> <br />Right to Require Performance, The failure of the City at an5' time to require <br />performance by the property owner of any provisions hereof shall in no wa5, effect the fight <br />of the City thereafter to enforce the same. Nor shall waiver by the City of any breach of <br />any of the provisions hereof be taken or held to be a wmver o? any succeeding breach of <br />such provision or as a waiver of any provision itself, <br /> <br />Severability. If an5' provision of this CLIP shall be declared void or unenforceable, the <br />other provisions shall not ~ a.ffecte& but shall remain in full force and effect. <br /> <br />Modification. This CUP shall not be considered modified, altered, changed or amended <br />in an), respect unless in ~aSting and signed b)' the Ci~' and IPS. <br /> <br />Amendment, Suspension or Revocation of CUP. The violation of any of the <br />mater/al terms of this CUP is ~ounds for suspension or revocation hereof consistent with <br />applicable law. Furthermore, the City specifically reserves the fight to amend, susr~end or <br />revoke this CUP consistent w/th applicable law as reasonably required to protect the public <br />health, safety and welfaze, and the environment. Specifically., bm without iimir/ng the <br />foregoing, the CiD' may amend, suspend or revoke this CUP consistent with applicable law <br />if the City Council reasonably determines that continued operation of the composring <br />faciliD, places the public health, safeD, or welfare or the environment in jeopard3, or creates <br />a public nuisance due to odors, 1/tier, debris or other nuisance factors. <br /> <br />Violation of Conditions. If Williarn Dubats or his successors or assigns violates an), <br />material term or condition imoosed by this CUP, it may be revoked and terminated <br />consistent with appi/cable law. i,Vithout Iirrfitmg the foregoing, the violation of any statute, <br />regulation, ordinance or permit condition imposed by lawful governmental authority and <br />governing operations on the Site is ~ounds for re,vocation and term/nation of this CUP <br />consistent with, applicable law. The change, alteration or amendment of an), such statute, <br />regulation, ord/nance or permit condition by any governmental author/Q, other than the Ci5' <br />shall not excuse William Dubars from compl/ance w/th .statutes, regulations, ordinances or <br />CUP conditions in effect on the date of the origina]'-issuance of this perrmt unless <br />comphance is wsdved or excused by the City. <br /> <br />//¢ <br /> <br /> <br />
