CHESTNUT RIDGE DEVELOPMENT AGREEMENT <br /> CITY OF RAMSEY <br /> ANOKA COUNTY, MINNESOTA <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF <br />RAMSEY, a m~anicipal corporation of the State of Minnesota (the "CITY"), and GOOD <br />VALUE HOMES, INC., a Minnesota corporation, whose address is 9445 East River Road <br />N.W., Coon Rapi~Is, Minnesota 55433 (the "DEVELOPER"). <br /> <br /> WITNE$SETH: <br /> WHERE~AS, the DEVELOPER is the fee owner of the following described property <br />situated in the CI4TY OF RAMSEY, County of Anoka, State of M/nnesota, and legally described <br />as follows upon r~:cording of the plat: <br /> Lots 1, 2i 3, 4, 5 and 6, Block 1; Lots 1, 2, 3, 4, 5, 6 and 7, Block 2; Outlot A, <br /> CHESTN~.~ T RIDGE, Anoka County, State of Minnesota. <br /> WHERE~AS, on March 22, 1994 pursuant to Resolution No. 94-03- , the CITY has <br />approved the tin,il plat of the Subject Property which plat is known as CHESTNUT RIDGE <br />(the "Plat"), whii:h approval is in accordance with the prelim/nary plat for Chestnut Ridge <br />approved on Janu~try 25, 1994 and which approval is contingent on certain requirements, including <br />DEVELOPER a~d CITY entering into this A~eement; and <br /> WHERE?~S, the DEVELOPER herein attests to ~he fact that there are wetlands located <br />on the Plat; and : <br /> WHEREAS, the DEVELOPER intends to cause the construction of the following <br />improvements in Ce Plat without financial participation on the part of the CITY, to-wit: Samtary <br />sewer, storm drai?age facilities, watermams and appurtenances, and su:eets with concrete curb and <br />gutter, which i~provements are termed Stage I Improvements in the C/ty Code ( Sta~e I <br />Improvements"); ~nd <br /> WHERE~S, City Code Section 9.50.50 defines "Stage I" Improvements and "'Stage II" <br />Improvements wt~ich respective definitions are used herein when reference is made to "Stage I" <br />and "Stage I/" Improvements; and <br /> WHERE~S, a trunk usage charge is required by the CITY for usage of its Trunk Sewer <br />and Water Syste~, which charge is $1415 per residential unit created; and <br /> WHERE~kS, no expenditure of CITY funds will be made until the City Code escrow <br />requirements hav~ been completed by DEVELOPER; and <br /> <br />NOW, THEREti'ORE, the CITY and DEVELOPER a~ee as follows: <br /> <br /> <br />
