17. <br /> <br /> GENERAL <br /> <br />Tree Preservation and Plal~ting Plan. In accordane with City Code and the policy <br />established by the City of Ramsey Park and Recreation Cornrmssion on June 10, 1993, the <br />DEVELOPER is required to submit a Landscape Plan for CITY approval that identifies <br />existing tree growth within the Plat that will be preserved during construction and new <br />plantings. It is herein agreed that the requirement for a Landscape Plan shall be fulfilled by <br />the DEVELOPER as follows: <br /> <br />a) <br /> <br />Minimizing the impact of construction on trees in accordance with Minnesota <br />Extension Service publication "Protecting Trees From Construct/on Damage" <br />(Publication #NR-FO-6135-S). <br /> <br />b) <br /> <br />Planting one two-inch diameter tree (or equivalent thereof) of an approved species <br />at the road frontage or in the front yard of each of the lots in the Plat prior to <br />issuance of a Certificate of Occupancy. In the event the weather is not conducive to <br />tree or sod planting at the rime of Certificate of Occupancy, the Building Perrmt <br />holder shall place a cash deposit in the amont of $200.00 for trees in an escrow <br />account with the CITY and upon verification of the plantsng being accomplished, <br />said cash deposit shall be refunded to the Builder Permit Holder. Failure of the <br />Buiider to comply with the planting requirement within a reasonable time frame <br />following a determination by the CITY that weather conditions are conducive to <br />planting shall We the CITY the authority to cause the planting, the cost of which <br />shall be charged to the escrow account and the builder shall not be eligible for a <br />refund of the cash deposit made for this purpose. <br /> <br />18. Tree Disease Prevention and Disposal. The DEVELOPER shall prevent the <br /> introduction and spread of tree disease into the residual tree popuiations of the Plat and <br /> adjoimng properties and reduce the impacts of construction on the residual property of the <br /> Plat and adjoining properties. The DEVELOPER in order to accomplish this shall: <br /> <br />a. Install physical bamers, such as snow fence, around trees that are to remain. The fencing <br /> <br /> shall be located at the dripline of these remaining trees. <br /> <br />b. Insure that all equipment operators will have readily available, a tree wound dressing and <br /> will apply it immediately to damaged oak trees if wounding occurs from April 15 through <br /> July 15. <br /> <br /> <br />
