NOW <br />CITY <br />findings of la,ct relating to <br /> .r <br /> <br />1. <br /> <br />Councilmember! introduced the following resolution and moved for its adoption: <br />~ RESOLUTION #94-04- <br /> <br />A RESOLUTI[ON ADOPTING FINDING OF FACT # RELATING TO A <br />REQUEST FI~OM SIDNEY NYHUSMOEN FOR A CONDITIONAL USE PERMIT <br />TO MINE A~D EXPORTS SOILS <br /> WHEREAS, the City of Ramsey received an application from Sidney Nyhusmoen for a <br />conditional use ~ermit to mine and export soils from the property legally described as follows: <br /> Lot 1, B!lock I, HY-I0 RAMSEY 4TH ADDITION, Anoka County, Minnesota. <br /> <br /> (the "St~bject Property") <br /> <br /> THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br /> OF I~AMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the <br /> the request are determined to be as follows: <br /> <br />That on[ March 15, 1994, Sidney Nyhusmoen, herein after referred to as "Applicant", has <br />properly, applied for a conditional use permit to mine and export soils in the I-1 Industrial <br />District~ <br /> <br />7 <br /> <br />8. <br /> <br />9. <br /> <br /> 10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />That th~ applicant appeared before the Ramsey Planning and Zoning Commission for a <br />public nearing pursuant to Secdon 9.03.04 of the City Code on April 5, 1994, and that said <br />public l~earing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated as a part of these findings by reference. <br /> <br />That th~ subject property is located in the Industrial District, and is approximately 4.4 acres <br />in size. <br /> <br />That rdining is not a permitted use in the Industrial District. <br /> <br />That th~ Subject Property is surrounded by Industrial zoning. <br /> <br />That t~e Applicant is proposing to strip the topsoil on the Subject Property, export <br />approximately 17,430 cubic yards of material, and replace the topsoil. <br /> <br />That nO fill materials are proposed to be imported to the site. <br /> <br />That n4 blasting will be employed in the mining activity. <br /> <br />That no excavation will take place within the road right-of-way. <br /> <br />That ~e existing drainage patterns will not be substantially altered by the proposed grading <br />plan. <br /> <br />That ~ere are other similar conditional use permits th'at have been approved by the City. <br />That tt~e mining operation will increase the traffic to the subject property and surrounding <br />area. <br /> <br />That t~e proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residir~g or working in the vicinity of the use or to the public welfare. <br /> <br /> <br />
