NOW CITY findings of la,ct relating to .r 1. Councilmember! introduced the following resolution and moved for its adoption: ~ RESOLUTION #94-04- A RESOLUTI[ON ADOPTING FINDING OF FACT # RELATING TO A REQUEST FI~OM SIDNEY NYHUSMOEN FOR A CONDITIONAL USE PERMIT TO MINE A~D EXPORTS SOILS WHEREAS, the City of Ramsey received an application from Sidney Nyhusmoen for a conditional use ~ermit to mine and export soils from the property legally described as follows: Lot 1, B!lock I, HY-I0 RAMSEY 4TH ADDITION, Anoka County, Minnesota. (the "St~bject Property") THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE OF I~AMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the the request are determined to be as follows: That on[ March 15, 1994, Sidney Nyhusmoen, herein after referred to as "Applicant", has properly, applied for a conditional use permit to mine and export soils in the I-1 Industrial District~ 7 8. 9. 10. 11. 12. 13. That th~ applicant appeared before the Ramsey Planning and Zoning Commission for a public nearing pursuant to Secdon 9.03.04 of the City Code on April 5, 1994, and that said public l~earing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. That th~ subject property is located in the Industrial District, and is approximately 4.4 acres in size. That rdining is not a permitted use in the Industrial District. That th~ Subject Property is surrounded by Industrial zoning. That t~e Applicant is proposing to strip the topsoil on the Subject Property, export approximately 17,430 cubic yards of material, and replace the topsoil. That nO fill materials are proposed to be imported to the site. That n4 blasting will be employed in the mining activity. That no excavation will take place within the road right-of-way. That ~e existing drainage patterns will not be substantially altered by the proposed grading plan. That ~ere are other similar conditional use permits th'at have been approved by the City. That tt~e mining operation will increase the traffic to the subject property and surrounding area. That t~e proposed use will not be unduly dangerous or otherwise detrimental to persons residir~g or working in the vicinity of the use or to the public welfare.
