ANOKA <br /> <br />[ON DECLARING TERMS OF CONDITIONAL USE PERMIT, <br />INDINGS OF FACT NO.~ , FOR MINING OPERATIONS <br /> 29-32.25-11-0009. <br /> <br />~,AS, the Ramsey City Council adopted Resolution No. 94-04- regarding <br />No. for this use and herein approves the Conditional Use Permit subject <br />:onditions. <br /> <br />IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On , 1994, a Conditional Use Permit ("CUP") was issued by the City of Ramsey <br />("City") to Sidney Nyhusmoen ("Permit Holder") for mining operations on the property legally <br />described as follows: <br /> <br /> Lot 1, BlOck 1, HY-10 RAMSEY 4TH ADDITION, Anoka County, Minnesota. <br /> <br />This permit is i~sued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. <br />conditions of thi,[ permit are as follows: <br /> <br />1. <br /> <br />o <br /> <br />The <br /> <br />This pem)~ it shall expire on May 1, 1997. <br /> <br />All equipment used for mining operations shall be maintained and operated in such a <br />manner ~b minimize noise, dust, and vibrations adversely affecting surrounding properties. <br />All equipment shall be kept in good repair. Abandoned equipment and rubbish shall be <br />removedlfrom the worksite regularly. ~ <br /> <br />All worlqsites shall be properly safeguarded to prevent the general public from depositing <br />garbage Or other refuse on the worksite. <br /> <br />Existing tree and groundcover shall be preserved to the extent feasible. <br /> <br />Mining 9perations shall be conducted in such a manner to minimize interference with the <br />surface ~ater drainage outside the boundaries of the operation. <br /> <br />No mining operations shall occur at below an elevation of 6 feet above the elevation of the <br /> [ . <br />water table on the works~te. <br /> <br />Fencing ~ay be ordered by the City Council or City Engineer anytime the permit is in force <br />and shall~ be installed within 24 hours of written notice. <br /> <br />Ail accesis roads from the mining operation to the pu, blic streets shall be maintained in order <br />to minim ize dust. <br /> <br />The max <br />a rate of <br />be left u <br />mining, <br />working <br />foot vert <br /> <br />imum slope other than the working face shall be sloped on all sides no steeper than <br />2 foot'horizontal to 1 foot vertical.
