City Attorney Goodrich reviewed the staff report. <br />Consensus was reached to place a resolution on the regular City Council meeting agenda for <br />May 31, 2011 accepting City Councilmember Jeffrey's resignation, declaring a vacancy and <br />scheduling a special election to fill the vacancy. <br />City Attorney Goodrich indicated the effective date of resignation will be May 31. The election <br />will be held on August 16, only in Ward 4. The election must be done in 90 days from the date <br />of resignation, which is August 29, 2011. <br />4) Consider EDA Recommendation for Full Service Restaurant Subsidy Policy <br />Economic Development/Marketing Manager Backman reviewed the staff report. <br />Mayor Ramsey noted it was agreed the subsidy would only be given one time, which was to <br />Acapulco. <br />Councilmember McGlone commented the language in the policy could be problematic. <br />Economic Development/Marketing Manager Backman explained the policy states it has to be a <br />full service restaurant, on Highway 10 or a frontage road. The Met Council defines a full service <br />restaurant as one unit of SAC /WAC fees per eight seats. <br />City Administrator Ulrich suggested .adding language stating the first two or three restaurant <br />proposals could be eligible, and note there is limited funding. <br />Consensus was to add this language to the policy, and that the application is subject to Council <br />approval. <br />Consensus was reached to approve the proposed Full- Service Restaurant subsidy Program <br />guidelines as recommended by the Ramsey EDA with changes as noted. <br />5) Consider Lease Agreement for 6811 Hwy 10 by TMBC, LLC, dba Crystal Pierz <br />Marine <br />Economic Development/Marketing Manager Backman reviewed the staff report. <br />Mayor Ramsey noted the previous leasers should be made to pay the money owed back to the <br />City before going forward with this lease agreement. <br />City Attorney Goodrich explained it doesn't matter who the owners subleased to. The lease and <br />contract is with the original renters, and they are still responsible. The signature on the contract <br />is an employee of PSD, the previous renter. Crystal Pierz Marine is subletting and they are not <br />responsible for the payment due from the original renters. <br />City Council Work Session / May 31, 2011 <br />Page 3 of 4 <br />
