CASE # STREET ,LIGHTING IN GREEN VALLEY ESTATES SECOND ADDITION ! IMPROVEMENT PROJECT g94-15 By: Steven Jankowski, City Engineer Background: , Prior to this c~e a public hearing will have been held on Improvement Project//94-15. This project consistsiof the installation of street lights in the Green Valley Estates Second Addition subdivision. A ~,opy of the feasibility study which outlines the nature of the improvements and the financial impact ~on the benefitted parties is attached to this case. The procedure ~e have been following, therefore, given the subdivision petition, has been to initiate a public .a-nprovement. After review of the project, Staff recommends that projects such as this be treated, at least in part, as a utility rate igcrease. If this in fact occurs without an assessment to property, the Council could proceed to orde~the improvement. Prior to doing so, however, Council would want to set a utility rate for rural subdivisions. In that such a rate does not currently exist, the Charter, Section 11.2, directs that the ate be set by ordinance after a public hearing. This particular public hearing was published for a plarticular subdivision improvement and not a utility rate. Given the above., regardless of the desires of Green Valley Estates or the Council on subdivision lighting in that lsubdivision, a utility rate to be availed to a larger area requires the hearing provisions. Council could set the utility charge for Green Valley Estates; it could not, however, use the rate gen.6, rally through its rural area. The rate proposed for this and other subdivisions is $13.65/quarter Without any additional assessment. Relative to Greox~ Valley Estates, specifically, should the Council determine to go forward, Staff recommends tha~ the improvement may go forward upon passage of an ordinance setting the utility rate (ordinance graft is attached). However, we had previously informed property owners that Council would ~ollow Chapter 8 of the City Code which allows for the petitioning process and subsequent assessment. Therefore, even with the procedural differences, Council should follow the same timing ~vhich allows the project to next be considered at the July 26, 1994 meeting.
