CASE # <br /> <br /> STREET ,LIGHTING IN GREEN VALLEY ESTATES SECOND ADDITION <br /> ! IMPROVEMENT PROJECT g94-15 <br /> By: Steven Jankowski, City Engineer <br /> <br />Background: , <br /> <br />Prior to this c~e a public hearing will have been held on Improvement Project//94-15. This <br />project consistsiof the installation of street lights in the Green Valley Estates Second Addition <br />subdivision. A ~,opy of the feasibility study which outlines the nature of the improvements and the <br />financial impact ~on the benefitted parties is attached to this case. <br /> <br />The procedure ~e have been following, therefore, given the subdivision petition, has been to <br />initiate a public .a-nprovement. <br /> <br />After review of the project, Staff recommends that projects such as this be treated, at least in part, <br />as a utility rate igcrease. If this in fact occurs without an assessment to property, the Council could <br />proceed to orde~the improvement. Prior to doing so, however, Council would want to set a utility <br />rate for rural subdivisions. In that such a rate does not currently exist, the Charter, Section 11.2, <br />directs that the ate be set by ordinance after a public hearing. This particular public hearing was <br />published for a plarticular subdivision improvement and not a utility rate. <br /> <br />Given the above., regardless of the desires of Green Valley Estates or the Council on subdivision <br />lighting in that lsubdivision, a utility rate to be availed to a larger area requires the hearing <br />provisions. Council could set the utility charge for Green Valley Estates; it could not, however, <br />use the rate gen.6, rally through its rural area. The rate proposed for this and other subdivisions is <br />$13.65/quarter Without any additional assessment. <br /> <br />Relative to Greox~ Valley Estates, specifically, should the Council determine to go forward, Staff <br />recommends tha~ the improvement may go forward upon passage of an ordinance setting the utility <br />rate (ordinance graft is attached). However, we had previously informed property owners that <br />Council would ~ollow Chapter 8 of the City Code which allows for the petitioning process and <br />subsequent assessment.
