Subd. 3. Billing Statements Billing statements for street lighting charges for the preceding period shall be mailed to each customer and shall be deemed sufficient notice to the customer of charges made, Said statements shall be due and payable by the date indicated on the specific billing statement. Subd. 4. Delinquent Account All billing statements not paid on or before the due date shall be considered delinquent accounts. It. shall be the duty of the City to promptly collect delinquent accounts, and the customer shall be duty notified or, in the case the customer cannot be found, then the person in charge of the premises. Subd. 5. Service Charges Any amounts due hereunder plus interest and penalty may be collected in an action brought for that purpose in the name of the City; or the Clerk may certify to the County Auditor the amount due for street lighting charges plus interest and penalty, together with the legal description of the premises served and the County Auditor shall thereupon enter such amount within the tax levy on said premises collectible with the taxes for the ensuing year, 4.41.04 VARIANCES The Council may permit variances from the strict application of any of the provisions of this ordinance if it is satisfied that there are special circumstances or contritions affecting the premises for which the variance is requested and that the granting of such variance will not materially adversely affect the health, safety or general welfare or public or private property. An), variation permitted under this provision must be noted on the permit. A public hearing is not required. 4.41.05 PENALTIES Any person violating any provision of this ordinance shall be guilty of a misdemeanor and shall be punished as law provides for such offense. Each day the violation continues shall constitute a separate offense. Any person violating any of the provisions of this ordinance may also be liable to the City for any expense, loss or damage occasioned the City by reason of such violation. SECTION 2: SUMMARY The following official summary of Ordinance ~-94-__ has been approved by the City Council of the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. It is the intent and effect of Ordinance ~94-__ to add Section 4.41 of the City Code, which Section is entitled "Street Lighting Utilities". Section 4.41 provides for setting street lighting rates and charges by City Council Resolution. SECTION 3: EFFECTIVE DATE The effective date of this Ordinance is thirty (30) days after its passage and publication, subject to City Charter Section 5.07.
