Said improvements shall <br />be installed by the building permit applicant or the homeowner at the time the Certificate of <br />Occupancy is issued or as soon thereafter as possible, weather permitting. In the event <br />these improvements are not timely installed, the DEVELOPER, on behalf of all <br />subsequent owners of lots within the Plat, agrees that the CITY may instatl sad <br />improvements on any lot(s) and specially assess its cost therefore against the tot(s). The <br />DEVELOPER hereby waives all right to a public hearing and other statutory fights or <br />City Charter fights granted a property owner relating to special assessments, including the <br />fight to appeal the special assessment for installation of the improvements described in this <br />paragraph. In add/don, the DEVELOPER grants the right to the CITY to enter on each <br />lot of the Plat in order to install the improvements described in this paragraph, in the event <br />it is necessary for the CITY to install these improvements and specially assess the same. <br /> <br />PERMITS, <br /> <br /> III. <br />OCCUPANCY AND <br /> <br />PROPERTY VALUES: <br /> <br />16. Requirements for Building Permits. No occupancy permit for any lot in the Plat <br /> shall be issued until (a) vehicular access to the lot is provided including the installation of <br /> Class V material on ail su-eets in the Plat; (b) site plan approval is granted by the CITY and <br /> an), additional expense incurred in ~ving sire plan approval has been reimbursed to the <br /> CITY; (c) a Certificate of Survey, including that information required by the CITY, has <br /> been supplied to the City Building Official; and (d) all the financial guarantees required by <br /> the CITY have been satisfied. <br /> <br />17. Rectuirements for Plumbing.
