WHERI~AS, the DEVELOPER desires to constuct the Stage I and Stage II <br />improvements, elcept for those Stage II improvements consn'ucted by the CITY. <br /> WltER~AS, no expenditure of CITY funds will be made until the City Code escrow <br />requirements haw been completed by the DEVELOPER. <br /> <br /> NOW, THEREFORE, the CITY and DEVELOPER a~ee as follows: <br /> I. <br /> STAOE I IMPROVEMENTS AND FINANCIAL GUARANTEES: <br /> <br />City Co~e. Compliance. That the DEVELOPER will develop the Plat in accordance <br />with the City Code, Section 9.50, entitled "Subdivision. <br /> <br />Conforr~,qnce wi~h Plan. The Plat shall be developed pursuant to the final plat <br />consisting of two (2) sheets, prepared by McCombs Frank Roos Associates, Inc., entitled <br /> F <br />Wood Po~hd Hills 4th Addition. <br /> <br />lncort)o~ation_ ; of All City Code Requirements. That the recitals above and the <br />provision~S of the City Charter, Subdivision Code, Zoning Code and Public Improvement <br />Code of the CITY, as amended to date hereof, are incorporated herein by reference. <br /> [ <br /> <br />Stage llImorovements Required. TheDEX,~-ELOPER agrees to construct the <br />required ~tage I Improvements according to the terms and conditions of this contract and in <br />accordance with DEVELOPERS' plans submitted to the CITY. Said plans shall be in <br />genera] cpnformance with the Grading Plan prepared by McCombs Frank Roos Associates, <br />Inc.and dated August 16, 1992, along with approved revisions. The final construction <br />plan for isanitary sewer, storm sewer, watermain, and street improvements shall be <br />submitted to the City Engineer for review and approval prior to construction. The <br />DEVELOPER shall also be responsible, at its expense, for installation of gas, telephone, <br />and elec~c ufiity improvements. Street Iights are the responsibih~ of the DEVELOPER, <br />however,I the CITY will arrange for their installation as a Stage II Improvement. The <br />DEVELOPER shall be responsible for completing the rough ~ading and providing lot <br />corner sta[kes prior to the installation of under~ound utilities. <br /> <br />Boulevard and Area Restoration. The DEVELOPER shall be responsible for the <br />cost of establishing seed or sod in all boulevards within thirty (30) days of the completion <br />of the s~eet improvements, and restoring all other areas disturbed by the development <br /> <br /> <br />
