Said improvement shall be installed by the building permit applicant or the <br />homeowner at the time the Certificate of Occupancy is issued or as soon thereafter as <br />possible, weather permitting. In the event this improvement is not timely installed, the <br />DEVELOPER, on behalf of all subsequent owners of lots within the Plat, agTees that the <br />CITY ma.,,.' install said improvement on an.,,, lot and specially assess its cost therefore <br />against the tot. The DEVELOPER hereby waives all right to a public hearing and other <br />statutory rights or City Charter rights granted a property owner relating to special <br />assessments, including the right to appeal the special assessment for installation of the <br />improvement described in this para~aph, in addition, the DEVELOPER ~ants the right <br />to the CITY to enter on each lot of the Plat in order to install the improvement described in <br />this para~aph, in the event it is necessary for the CITY ~:o install this improvement and <br />specially assess the same. <br /> <br />III. <br /> <br />PERMITS, OCCUPANCY AND PROPERTY VALUES: <br /> <br />13. Requirements for Occupancy Permits. No occupancy permit for an.',, lot in the Plat <br /> shall be issued until (a) vehicular access to the lot is provided including the installation of <br /> Class V material on all streets in the Pla,:; (b) site plan approval is Famed by the CITY and <br /> an,,, additional expense incurred in giving site plan approval has been reimbursed to the <br /> CITY; (c) a Certificate of Survey, including that information required by the CITY, has <br /> been supplied to the C/ty Building Official; (d) a tree planting has been accomplished in <br /> accordance with Item #:I7 of this AFeement; and (e) all the financial guarantees required by <br /> the CITY have been satisfied. <br /> <br />14. Development oF Certain Lots. Lots 1 through 5 of Block 1 are considered r/parian to <br /> Wetland #2-1 i4P and all structures, including decks, are subject to a 50 foot setback from <br /> the Ordinary High Water 5'lark. Compliance ~4th this requirement will res~ct the style of <br /> home that can be built on these lots, especially on Lots 2 and .3. <br /> <br />15.
